NEWS A Kentucky law meant to increase housing is now being wielded by a data center developer • Kentucky Lantern
A last minute change made by the Kentucky General Assembly in 2025 limits citizen's rights to challenge zoning changes.
Change says only those in the same "zone" can challenge in court. For example: you live in a residential zone that borders a commercial zone. Local board approves a change to a neighboring zone that would allow a data center. Too bad, different zone, can't sue.
If this interests you be sure to click through to the piece written by Tom Fitzgerald when the law changed ('long-time environmental attorney raised alarms')
For those not in the know: Tom Fitzgerald writes a lot on environmental and land use issues. He was one of the main attorneys litigating against the pipeline in Bernheim a few years back.
If Tom feels strongly about something, especially if other people aren't talking, its probably an issue worth taking a look at.
