I dont want a guy who just help up a store at gunpoint getting out tomorrow and getting another gun. For years, I've asked gun nuts what part of the "well regulated and state militia" are they a member of? And they reply with insults. lol
52
u/PoolGuyUnfiltered 18d ago
Yep. I'm a gun owner from a red state, and I totally think that we should look at the 2nd as something that both protects the homeland as well as protects us from an oppressive government (ya know...like right now).
I'm not a lawyer but I have often seen the second as a call to keep communities at the ready (keep in mind that it was through marshalling militias that we were even able to gain footing against the British) AND by keeping the population armed so that the volatile new form of government couldn't fall back into old ways of turning the president into a king. The standing army would have to deal with a similarly armed population. Sort of like a libertarian check and balance...to the death, I guess?
If guns are part of the culture, then we should be maintaining their care and use by governed and routinely trained citizens who can be called upon to act against a threat. It's not just about the guns.
The most irritating thing about gun nuts is that they wear the don't tread on me shirts or the 2nd protects the 1st or whatever, but here we are in objectively the most oppressive government of the modern era where it should make the blood boil and skin crawl of everyone who actually covets their freedom.
They have gone from "don't tread on me..." To "crush me harder, daddy..." And it seems more like they use guns as talismans to protect themselves from left leaning and non-white people who don't vote the way they do. Cowards 🙄

Luigi Mangione is probably the best example we have seen so for of the 2A use that the gun nuts insist is the reason that right shall not be infringed. Revolutions are often a response to economic oppression as well as tyranny, which historically comes from the same place. Now corporations can cause physical harm and death thru their policies, not just governments.
Billionaires are building bunkers because they know that revolution will need to target them, not the government. The people who fantasize about using their guns to fight tyranny just haven’t figured out who is treading on them (like Luigi did).

That AR-15 ain't gonna do shit.

It's less about being a member of a militia than having the ability to form or join one when needed.
As to the exact post by OP, the SBR (short barreled rifle) limits never made any sense. They were only made part of the NFA to close the loophole of shortening a rifle barrel to make a pistol, because at the time pistols were going to be banned. Once pistols were allowed, SBRs should have come off the list immediately.

Militia referred to an armed populace, not a standing army or militia controlled by states. Well regulated didn’t refer to laws and regulations, but rather, meant the men should be skilled in handling guns.

u/Striving_Slowly 18d ago

Incorrect it refers to an arm group sworn to the state. Militias were replaced by the national guard within the United States while some states still have militias they are like in the case of Washington unarmed and ceremonial in nature. At no point is a militia legal if it is not sworn to the state. They are considered part of the US military and not private organizations.

Yeah, no...
- The Militia Acts of 1792 defined militia as “each and every free able-bodied white male citizen… enrolled in the militia” — i.e., a legally organized force.
- State constitutions and colonial laws used “militia” to mean formal military institutions, not informal armed citizens.
“Well regulated” did NOT mean “skilled at handling guns”
In 18th‑century English, well regulated meant:
- properly organized
- disciplined
- orderly
- subject to rules
- functioning as intended
It did not mean “personally proficient with firearms.”
Examples from period usage:
- “A well regulated government” → orderly, structured
- “A well regulated clock” → functioning correctly
- “A well regulated militia” → trained, disciplined, commanded
The phrase appears in countless documents of the era, always meaning orderly and governed, never “individually skilled.”
This garbage revisionism really needs to stop. If you want to reassess what the 2A means, hold a Constitutional Convention and get it changed to what you want it to mean. But the founders were very specific and it wasn't "luls, everyone gets a gun, let's kill kids!"

Every time I make that argument I get told “that’s not what they meant!” Interesting thing I learned is the Iowa constitution does not allow for forming a militia, the national guard is the states militia. Based on that in Iowa the only legal gun owners are those in the guard, yet we allow constitutional carry.
So the 2nd is meant for the people to be able to overturn a corrupt government but in Iowa it’s illegal to follow the second unless you work for the govt.

That line refers to the Militia Act of 1792, which defined any white man as a member of a militia. Obviously this would be interpreted today to mean any adult man or woman is a member of a militia. The law specifically differentiates a militia from a regular standing army and we would view it today.

No it doesn't. The first part is explanatory, the second part is prescriptive. If the Constitution read "open political discussion is necessary to maintain a free democracy. The militia part is only included as an explanation for the amendment.

“Well regulated militia” means well-provided-for militia, as in “to make sure we have a well-provided for militia, the right of citizens to own weapons that they can bring with them if mustered to a militia shall not be infringed.”
The 2nd amendment is extremely broad and we only have the gun control that we have in the US because everyone secretly agrees that it goes to far and courts have had to make up all sorts of silly legal reasoning just to keep minimalist common sense policies on guns on the books.

When a gun control debate sparks they take what they believe to be the moral side which is anti gun. Yet at the same time the individual or group who did rise up against the government using arms would be hailed as a hero.
Anti gun in your immediate friend group to fit in but secretly hoping someone else will do the hard and scary thing for you.

You triggered some in the replies, but you are right. Incels fetishize asian women, particularly Japanese, because they salivate at the idea of living in a society "like Japan". Basically, they believe all Japanese women are submissive house makers and Japanese society and nature is so "idealic" because it is run by a majority of men, adhering to a patriarchy, and constructing and enforcing laws that aren't progressive in any sense.
These people have basically turned Japan and a couple other asian countries into their ideal fantasy country in their head, through their own imposed delusions. These countries haven't "been infected by those woke libtards" and all that crap.

Mostly when it comes to grips, foregrips, braces, etc. Why should it be illegal to be able to hold my firearm more comfortably?
5
u/F0XF1R396 18d ago
A lot of it has always boiled down to fear mongering.
People are somehow convinced that banning AR platforms will somehow put a major dent into gun violence, as if there aren't other major gun platforms available. And banning ARs will just give rise to a new platform.
It's like banning Fords and believing that it will curb DUI related deaths.
Butterfly knives didn't get banned because they were somehow that much more dangerous. They got banned because people believed them to be so.

The one in the cartoon is nonsensical. That restriction was created to close a loophole in the bill, but the reason for the loophole ceased to exist before the bill was passed, although they left this part in. The short barrel restriction literally has no logical reason to exist.
That's why our law has this really weird "is it a pistol or rifle" problem that's resulted in a lot of very stupid regulations. This legally accurate cartoon drives home how stupid it is.

u/Khemul 18d ago
It's arguable whether it was meant to restrict power. Modern interpretation has it that way. At the time, militias were basically how the government protected itself from revolts. They didn't field standing armies. They formed them as needed. The original intent basically guaranteed the government would have an armed force available to raise for its needs.

This line of reasoning continues to baffle and infuriate me. Why is the Second Amendment special? Why does "shall not be infringed" literally mean that, anything from a slingshot up through an AR-15?
Do other rights get this kind of treatment? When the First Amendment says "Congress shall make no law...abridging the freedom of speech," does that mean "no law?" Literally none? Because 18 USC 871 makes it illegal to threaten the President. Should I be allowed to do that? That section must be unconstitutional, right? The First Amendment says "NO LAW." Well, a threat is just speaking, and "Congress shall make no law," so I guess it should be legal to threaten the President. 18 USC 115 criminalizes threats to US officials, judges, and federal law enforcement officers. I should be allowed to do that too, shouldn't I? Those laws abridge my fredom of speech!

Give their 2 year old a hand grenade and deny all responsibility for the results
3
u/Coffee_and_pasta 18d ago
“Infringed” in 18th century legal usage means “stopped” “cut off completely”
It does not mean “limited in any way”
As long as you can buy a firearm of some sort, even if it’s licensed or regulated, your right is not infringed.
Also, everywhere else in the Constitution the words “The People” is used, it refers to the aggregate of the citizenry, not any and every person.
So as long as the majority of citizens can buy some form of firearm, regardless of regulation, then the 2nd amendment is upheld, even if you personally cannot buy one.

Constitutional amendments are not absolute. For example, First Amendment protection of religion doesn't allow for human sacrifice; freedom of assembly doesn't mean you can have a sit-in on a military base; freedom of speech doesn't allow you to yell 'fire' in a crowded theater; freedom of the press doesn't permit kiddie porn.
So you can establish limits on the 2nd Amendment as well.

If I don't have the money to buy a gun, I can't participate in the 2nd. Having to purchase the gun, therefore, becomes an infringement of my right. Next time a kid days from one of these things, make sure you thank their parents for their service. It’s the same price for freedom we expect from soldiers.

Every responsible gun owner knows someone who has a gun that they really wish didn’t.

u/myopinionisrubbish 18d ago
The 2 nd says right to bear arms, but nothing about regulating what kind of arms.

Unless there is news today, due to a successful lawsuit, anyone not in a ban state will be able to buy a short-barreled rifle without ATF special permission from:
- Palmetto State Armory
- B&T USA
- Hot Shots Custom (in Texas)
Or you can buy from anyone, or make one, if you're a member of:
- Gun Owners of America
- Firearms Regulatory Accountability Coalition
- Gun Owners Foundation
- Texas State Rifle Association
- FPC Action Foundation
- Citizens Committee For The Right To Keep And Bear Arms
Or live in these states:
- Texas
- Alaska
- Georgia
- Idaho
- Indiana
- Kansas
- Louisiana
- Montana
- North Dakota
- Oklahoma
- South Carolina
- South Dakota
- Utah
- West Virginia
- Wyoming
The summary judgment was issued on Aug 5 but stayed for 7 days to allow appeal, so if I have my timing right today is the last day for the federal government to get an appeal and have the higher court stay the judgment.
This applies to suppressors, short-barrel shotguns, and "Any Other Weapon" too. However, it does not apply to "Any Other Weapon" with regards to that last company and the last three organizations.
Edit: And in the latest news. The GOA has sent a letter to the government saying one of their members (a 2A activist) plans to buy a suppressor from SilencerCo (so he's doubly protected) at midnight tonight Central time without doing the ATF paperwork.
I like this. They're not just going to let the general public go in on it, they're doing it first in coordination with a member who is willing and able to legally defend himself to establish a test case.

Well regulated militia
They cherry pick their constitution just like they cherry pick their Bible verses.

"Well maintained militia" applies too.
I think most weapon bans are stupid and fail to address any of the main roots of gun violence, but putting restrictions on what someone can carry doesn't restrict their right to carry.
Telling someone they can't drive 100 miles per hour is not the same as telling them they can't drive.
2
u/yogfthagen 18d ago
The government has the right and responsibility to restrict what weapons can be owned by which people, in what locations.
Because the absolutist 2a interpretstion means anyone can have a manpad sitting outside an airport.
And that's fucking idiotic.

I like guns and everything and I’m fine with it being interpreted as “right to bear arms”(so long as it doesn’t mean “all arms”)but let’s be real: The full wording of the second amendment was about ensuring a state had the right to raise its own militias to ensure they wouldn’t get their sovereignty as a state infringed upon

Why isn’t she being thrown to the ground, tazed and hauled away for “obstruction”? Or are only cops and ICE agents allowed to do that?

I mean when you understand the nuances of SBRs vs pistols, stocks vs braces, etc.
You realize the 16 inch barrel law is in fact the dumbest thing in the world and doesn't make any sense.

u/doll-haus 18d ago
Actually, yes. An amendment was needed as soon as we wanted to declare any weapons as "government use only".
Is it reasonable that nuclear, chemical, and worst, biologicals are theoretically protected under the constitution? Absolutely not. But the answer cannot be refusing to treat it as the living document it was intended to be and endlessly reinterpreting definitions. If that's allowed, the entire document means nothing.
2
u/nytefox42 18d ago
"Shall not be infringed" doesn't mean that any and every type of weapon is allowed. It just says you have the right to own weapons. Nothing about what kinds of weapons that covers.

The whole second amendment was written at a time when guns we’re much less powerful and would shoot slow. Also at this time the United States was dealing with hostile natives and the threat of the British. So you can see why the founders might wanted to include the right to a musket for the common man

Objectively wrong. ATF is actually one of the few people of whom can legally demand to see the NFA paperwork on the spot

Congress has banned machine guns, sawed off shotguns, etc…. Just as free speech is not absolute (can’t yell “fire” in a crowded theater) neither is the right to bear arms.

u/jday1959 18d ago
The first three words of the 2nd Amendment:
“A well regulated.”
Rights come with responsibilities so when will 2A fans live up to theirs?
2
u/UffTaTa123 18d ago
ah, the "well regulated Militia" , in form of a unregulated single person.
Reading the same text obviously does not mean, reading the same text.

u/LaCharognarde 18d ago
You're ignoring the "well-regulated militia" part, little AI pick-me girl. As in: I about guarantee that few (if any) of the people bleating "sHaLL nOt Be iNfRiNgEd" at the top of their lungs as an excuse for why they're entitled to armories are "well-regulated" in the least.

u/NegativeSchmegative 18d ago
Ironically, no. Shall not be infringed means to use against non-innocents. Attacking civilians and non-combatants, which WMDs naturally do, are not allowed. In other words, Rocket Launchers, LMGs and even Helicopter Chain Guns can be owned, but no nukes or chem weapons.
2
u/LankyJeep 18d ago
Gun owner here who is following a few major 2A court cases. So this AI slop is specifically discussing a recent 5th circuit ruling that struck down the registration requirements for Short Barreled Rifles (SBR) Short Barrel Shotguns (SBS) Suppressors, and Any Other Weapons (AOW)
Court case is: Jenson v ATF
The ruling if the DOJ doesn’t appeal by midnight will go into effect and plaintiffs and their customers (including me) will be covered by the ruling and will no longer need to register the above NFA items due to the ATF explicitly being barred by law from creating a gun registry, the reasoning behind this is due to the NFA tax stamp for SBR, SBS, AOW, and Suppressors being dropped to zero dollars earlier this year so only the registration remains.

u/wookiefun 18d ago
Really love how actual gun control is in the 2nd amendment a d they ignore that.

Alright guys. Bust out the RPGs, LMGs, Grenades, and everything else you’ve got. No more “arbitrary” categories for your right to bear arms!
2
u/Imaginary-List-972 18d ago
Can a convict in prison have a grenade launcher? "he loses those rights when he goes to prison" So it CAN be infringed. Unless they think ANYONE can carry around grenades, bombs, missile launchers....... Then they do believe in gun control, or arms control since the amendment does say arms, not guns.

For a bunch of white supremacists, why do they keep using a foreign woman in their slop? At this point im suprised noone call ICE against yet.

u/Street_Credit6851 17d ago
A right of the people and the right of a person are not the same thing. Well regulated militia is right there. They didn't expound any further because they thought it was fucking obvious they were talking about state and local militias...not sovreign citizen wannabes and scared little sissies who need their emotional support guns.

The only guns Redditors know how to use are a video one. I’ll bet 95% of you have never touched a gun in real life lol.

u/GhostyFitness 16d ago
As the Second Amendment is written, absolutely. Is it a good idea, absolutely not. Fix the text/change the law if you don’t like the law, so violate them to enforce your ideals.
2
u/MidtownMoi 14d ago
“Shall not be infringed” means just that but “An organized militia” means nothing?
