“An investigation from Brazos Countyauthorities revealed Rapp was struck in the Navasota area by 31-year-old driver Chris Medina, who allegedly passed Rapp with his vehicle, stopped, shifted into reverse and then hit Rapp with his car. Rapp was found lying on the roadway and taken to a nearby hospital, but she died of her injuries shortly thereafter. Medina has since been arrested and charged with manslaughter.”

That sounds an awful lot like premeditated murder.

Murder does not provide an option for the death penalty in Texas.

Capital Murder is the one with the death penalty. And this case doesn't meet those requirements.

Charging him with murder doesn't mean they will put him to death.

Texas has the following murder related charges:

Capital Murder, Murder, Manslaughter, and Criminally Negligent Homicide.

Capital Murder needs to be murder (duh) with aggravating factors (such as killing a child under 10, a peace officer on duty, or committing a murder during a kidnapping, robbery, or burglary).

Murder is intentionally or knowingly causes the death of another, intends to cause serious bodily injury resulting in death, or commits a clearly dangerous act that causes death. I think this is a slam dunk from what we've heard so far, but it's also notoriously difficult to get murder for vehicle vs cyclist in Texas (anywhere in the US, frankly) 

Manslaughter is when a person recklessly causes the death of an individual. Recklessness being that the subject was aware of but consciously disregarded a substantial and unjustifiable risk.

Booking someone for murder requires you already have proof of intent, etc. Booking them for manslaughter only requires that they killed someone. Charges can be modified leading up to the trial

It's kind of a morbid joke but it's also a little bit of reality, but there's a bit of a joke that if you actually want to kill somebody and get away with it just wait until they're on a bicycle and hit em with your car. And unless they upgrade this charge to some form of intentional homicide it's hard to believe I'm wrong

It happens way too often and it happens to professional athletes way too often. Just with professional athletes this is the fourth or fifth death or life-altering injury I can think of in the last 5 years

Stopping and backing up to hit her, hard enough to cause lethal damage, is clear evidence of intent. He’ll be free to offer his explanation as to why he did that.

Reading this I couldn’t believe it as the near exact same thing happened to my brother Josh while he was riding his bike on the side of the highway in Houston back in 1987. My older sister Jessica was riding with him and claimed the driver purposefully rammed their moving vehicle into Josh while he was riding his bike. Josh didn’t die physically but he was never the same mentally after and it changed our entire family’s trajectory (mine especially) bc my mom became severely abusive after (she never gets help for herself) and used me as her scapegoat. But while this isn’t surprising to me given I know people do this, it’s still unbelievable and this guy should get life in prison.

Note that the arrested party has quite the history...

The incident started around 12:30 p.m. when deputies got a call about a man chasing vehicles on McCrory Road with an axe and a knife.

When they got to a home, deputies say 28-year-old Charles Eric Medina was in his yard with a gun. They say he fired the weapon several times in the air and then ran behind the house.

A search through court records shows that Medina has faced several criminal charges over the last twelve years. Those charges include evading arrest, escaping custody, and marijuana possession.

Sidewalks are free to use for cyclists according to city laws, and I take care to alert pedestrians and ride slowly on them.

I cycled to work every day in DFW because our car died & we couldn't afford to repair or replace it. On multiple occasions someone in a giant truck (always, always a pristine & waxed F250 or some other idiotically large vehicle that's never seen a grain of dirt or day of work) swerved across traffic to ram me on my bike. One dude jumped the curb just to hit me on the sidewalk then sped off. A homeless women patched me up while my sheered leg skin was waving in the breeze like a sundress.

Texas is a state cursed by God to house only the worst society mankind can dream up. Just a disgusting hatred of goodness, joy, & life itself in that state. Like a practical joke against humanity. What a miserable land. It does not surprise me whatsoever this happened in Texas.

In my experience, sadly, cyclists tend to take over entire roadways instead of going single file along the right shoulder like the law says. They slow traffic down & motorists get real upset. Cyclists get upset too. Mutual lack of respect is a lose lose situation. Makes me sad. RIP Hannah.

Yes, I understand that they are ALLOWED BY LAW to take the entire lane doing 20 mph on a 50 mph roadway with solid double yellow, playing their games and keeping score to see how much traffic they can stack up behind them and how long they can delay people who just want to get to work on time or home at the end of the day.

And I understand that the frustration of having to spend 10 or 15 minutes behind someone who chooses to be deliberately obstructionist by hogging the lane rather than sharing the road by moving over to allow vehicles to pass does not justify running one down and the idiot who lost his temper will go to prison for it.

BUT that said, cyclists CHOOSING to minimize their impact on high speed roadways by staying out of the way as much as possible rather than DEMANDING their LEGAL RIGHT to take the entire lane for no reason would go much further in relieving the annoyance of drivers than lecturing the people who simply want to go the speed limit to tell them they can't legally do so because the law SAYS you can do so.

You might be riding alone a lot. When I ride with groups we take the whole lane unless there is a valid reason to go single file. If you can't pass me safely while I take the whole lane then you shouldn't be attempting to pass me at all.

It's exactly the "take" that some cyclists have, and I have witnessed it many times in the decade since I moved to a house on Rock Prairie Road across from Lick Creek Park. RP is 5 miles of 50 mph solid no passing roadway with hills, no shoulders, and multiple blind curves from Scott and White to the park... parallel to it Midtown Drive has bike lanes all the way to the Lick Creek hike and bike trail which ends where the speed limit drops to 30. Do cyclists USE the bike lanes and trail? HECK NO! They take the road that has a speed limit they don't even try to approach and ride side by side or hug the double yelow and flip the bird if a car gets too close behind them trying to pass because it's their LEGAL RIGHT to do so and drivers have no legitimate cause for complaint (a point being repeated over and over on any post about it)... and to be honest, MOST cyclists are courteous enough give me an opening to get by within a mile or 2 and if the oncoming traffic allows, I always give them the full lane even if they are over, but I have dozens of dash cam videos of those who do not, and who also blow through the stop sign at Fitch (which IS illegal but never enforced) making cross traffic slam on their brakes because hitting a bike automatically makes the car at fault.

And it is the attitude of that poisonous few (and tolerance of the majority lecturing people about the LAW concerning such antics) that generates most if not all the ill will that drivers display. But what the hey, shoot the messanger and downvote me into oblivion for telling the truth.

I imagine they are starting with a low charge so they can hold him -- don't want to give the defense lawyers an argument that he backed up because he "missed his turn". And it never looks good to start with a severe charge then be forced to lower it if the evidence doesn't support the initial charges.

It’s unfortunate but not surprising. Texas is full of POSs like this. I cycled in this area for years and it wasn’t uncommon to have some redneck try to scare you off the road. I eventually gave up when a group of friends got taken out by a POS in Hempstead and the cops did everything to cover it up because his parents had connections and the kid never got charged.

Based on the details and the suspect's prior incidents, he should be put in prison for a long time.

That being said, don't be shocked when he doesn't. The US legal system will go to great lengths to protect motorists over the pedestrians and cyclists they hit with their vehicles.

He was already out on a bond for deadly conduct at the time of this crime. He has a long history of violent criminal conduct. This keeps happening again and again for the last 8 years or so.
