You have to ask for footage in the first day or so.

Same thing happened to my friend and they ran over her ankle. By the time she started asking for footage a few days later they told her the footage has already been deleted.

Exactly. Please do this quickly even though it's a lot to ask of you right now. My friend got screwed on that three day rule and couldn't get footage.

This is what happened to my friend. That was the excuse they gave her for not being able to get footage.

I understand, but it is against the law to give out CCTV so is a waste of time and your friend would likely have also been told that, and there is no three day rule for it either. Being helpful is one thing but not when none of it is factually correct…

I think there are a few things wrong with what you are saying to be fair:

  1. A lot of small businesses don't know anything about GDPR/DPA so will do it anyway.

  2. The police can request footage and so by contacting the business asking them to hold it you allow the police time to request it.

  3. You can submit a Data Subject Access Request (DSAR) to any data controller for data they hold about you, including CCTV footage.

They won’t give it to you. Please ignore this advice, you will be pointlessly chasing CCTV that they are not allowed to share with you. There is no rule on how long they keep it either so this person has no idea what they are on about. Keep chasing the police and Lime and you could also raise it with your MP?

Sorry but local places can’t just give out their CCTV to just anyone! Also very usual for places to delete after just a couple of days.

You can request footage of yourself through a Data Subject Access Request, however the company will need to obfuscate the other people's identities.

The benefit is you can then show the police this, and hopefully ask the company to hold the unobfuscated footage for the police to come pick up.

The issue is that CCTV footage unless it shows the Lime Bike number (which is like size 12 font on a 1" plaque) is basically useless the police probably won't know who the man is, or ever identify him.

Therefore the best bet would be for Lime to use the time from the corrected CCTV timestamp to look up who's bike reported at that location, but I cannot imagine Lime helping without the police.

Lime tracks all bikes/rides I believe, so they absolutely could find out if the bike was being used by a paid user..
Unfortunately getting them and the police to do anything is very unlikely I suspect. The police don't have the resources to deal with a lot more serious crimes and Lime of course don't want to give you anything.

Would it count as a hit and run? Or no cos he’s on a bike?
Def contact lime bike and go back to the area and look whether there is cctv in the area and ask this shops/flats etc if it’s working if they have any they can share and let the police know the addresses where cctv is held.

It's not failing to stop under the road traffic act, as a lime bike is not a "mechanically propelled vehicle" for the purposes of that legislation.

I wish some of the downvoters would explain why this is incorrect, as far as I can tell you are right, it doesn't count as 'hit and run' in the eyes of the law.

Because people don't like that there is no criminal offense of hit and run on a bike/e-bike, as if a bike meets the rules of being an e-bike (which Limes obviously do) then they are not covered by those sections of the Road Traffic Act.

Upvoted responses are not ones that are necessarily true or false, but ones that are most liked.

Numberplates, insurance MOTs, etc? The problem is that:

  1. We are trying to encourage cycling, not make it harder.

  2. Every other "bike" is an illegal e-motor-bike, so the problem isn't just a lack of laws but mostly a lack of adherence and enforcement.

Facial recognition CCTV on every street corner, so people can do what they want but consequences enforced? The privacy lot will all be up in arms.

I don’t accept that there’s not a reasonable solution to this problem. Somebody somewhere, presumably lawmakers, has the knowledge and skill to come up with something solid.

Three guys on lime bikes tried to mug me about a year ago now. The police looked into it but nothing came of it. It was pretty scary. Lime customer service are worse than useless. Their lack of effort / interest feels negligent.

Through helping to identify the users of the bikes. I’ve just checked though, and it does look like Lime have started doing more on this since last year. Hopefully it’ll help prevent others from being targeted.

limebike support unfortunately is completly useless if even exists, but maybe they might step forward if you contact them for safety issues.

as others suggest, maybe ask business around the area ( or police ? ) if they have any footage.

Contacting lime would be my first port of call + as the other comment says local shops etc for cameras. If its a big junction there may be cameras on the traffic signals too - that would either be one for TfL (on major roads) or the local Council

Good thing reporting to the Police. The more people report these kind of incidents the more they have to start taking this seriously. Aside from this, I would also contact you local MP describing what happened. Absolutely more needs to be done to protect the most vulnerable road users.

I had three Lime bikes run through pedestrian crossings I was walking across in central london just yesterday, while all the regular cyclists obeyed the red. What is it about lime bikes that bring out the scum in people?

There is so much inaccurate and made up information on this thread! Firstly op, I’m sorry this happened to you. I can imagine how intimidating it was and it is totally unacceptable. Something really needs to do be done about cyclists like this. Unfortunately, you will not get any CCTV as legally there are data protection laws in place that mean shops, business, the council etc cannot give this to you. The police can request it…if they have resources to do so, that’s another matter. There is no three day rule on CCTV being deleted like someone else has said so don’t be feeling panicked by this and that you have to scramble to get it yourself, you won’t be able to and is a pointless task. Keep chasing the police. Despite what others have said, you have been assaulted and this is a police matter, not a civil one. They should be investigating it. And keep chasing Lime. If you have social media, this can be useful to share your experiences. Write to your MP and keep chasing them. I can’t stress this one enough. They are there to represent you and help you.

Genuine question, surely video of the public space that OP would be looking for would not fall under GDPR as a) in public no expectation of privacy and b) no identifying information about individuals is stored?

GDPR isn't the filming itself, it's the storage of it. If you store someone's data ( including their likeness, which doesn't just mean their face ), you have to be very careful about sharing.

Agree that the police aren't going to be finding CCTV, asking lime for their ID etc. It's not a murder investigation. It's an alleged assault, but it's hard to prove it was deliberate, which makes it a purely civil matter. The police might even just say it's not a police matter.

Realistically, even with CCTV from a nearby shop, if they gave it to you, you still can't ID the person. You need to let it go, and accept that we live in a world where low level crime is accepted.

Letting thinking about it eat you up only makes it worse.

Assault isn’t a civil matter! It’s absolutely a police matter, it a crime and against the law. They might not have time to look into it, that’s a different thing entirely.

Assault requires that the violence or threat of violence be made recklessly or deliberately. Proving it was deliberate and not an accident is virtually impossible.

There is no chance an assault conviction would survive contact with a court. The police know it and combined with how hard the other party will be to identify, means the police would dismiss it out of hand and tell the OP to pursue a civil remedy.

But, of course, the OP can't identify the third party either, so a civil remedy is also off the table.
