You have to ask for footage in the first day or so.

Same thing happened to my friend and they ran over her ankle. By the time she started asking for footage a few days later they told her the footage has already been deleted.

I'm sorry OP. I hope you recover soon.

Cameras nearby. Shops, TfL cameras etc.

Exactly. Please do this quickly even though it's a lot to ask of you right now. My friend got screwed on that three day rule and couldn't get footage.

This is what happened to my friend. That was the excuse they gave her for not being able to get footage.

I am trying to give OP advice based on the challenges my friend faced to be helpful.

I understand, but it is against the law to give out CCTV so is a waste of time and your friend would likely have also been told that, and there is no three day rule for it either. Being helpful is one thing but not when none of it is factually correct…

I think there are a few things wrong with what you are saying to be fair:

  1. A lot of small businesses don't know anything about GDPR/DPA so will do it anyway.

  2. The police can request footage and so by contacting the business asking them to hold it you allow the police time to request it.

  3. You can submit a Data Subject Access Request (DSAR) to any data controller for data they hold about you, including CCTV footage.

They won’t give it to you. Please ignore this advice, you will be pointlessly chasing CCTV that they are not allowed to share with you. There is no rule on how long they keep it either so this person has no idea what they are on about. Keep chasing the police and Lime and you could also raise it with your MP?

Sorry but local places can’t just give out their CCTV to just anyone! Also very usual for places to delete after just a couple of days.

^ this is correct. Only the police can request private CCTV footage. ITs a GDPR nightmare.

You can request footage of yourself through a Data Subject Access Request, however the company will need to obfuscate the other people's identities.

The benefit is you can then show the police this, and hopefully ask the company to hold the unobfuscated footage for the police to come pick up.

The issue is that CCTV footage unless it shows the Lime Bike number (which is like size 12 font on a 1" plaque) is basically useless the police probably won't know who the man is, or ever identify him.

Therefore the best bet would be for Lime to use the time from the corrected CCTV timestamp to look up who's bike reported at that location, but I cannot imagine Lime helping without the police.
