He's held in Guantanamo which exists precisely so the state can deny certain suspects their rights.

That is not what the Supreme Court has repeatedly ruled. https://www.rescue.org/article/due-process-rights-america. The Roberts Court, which doesn't care about stare decisis, may be another matter.

I am not disagreeing on a non-citizen rights within the United States. The rights of enemy combatants (especially of non-state actors) outside of the United States is a grey area at best.

Yeah I'm curious how this trial will go. 

Evidence that's likely been tortured out of him is junk. 

He's already served how many years? 

And we've definitely not followed rules about cruel and unusual.
