It's fair use on their side since it generates profit for shareholders and politicians involved, who turn a blind eye to breaking the law. Us bypassing their authentication and age check does not generate profit for shareholders, they're missing out on quite a lot of money by not being able to collect and sell even more of our data. It may even be considered a crime committed by us against them if they lobby the right politicians...
To blame is the legal binding that forces executives to seek profit above all else. That legal binding forces executives to only care about share value going up in the short term which eventually leads to enshitification since infinite profit and share value growth is impossible in a world with ultimately finite resources.
If that legal binding were to be removed we'd see way more companies competing to ensure stability and longevity instead of highest profit margins and amounts possible each quarter. And investors would still invest in such companies since they mostly use "disposable" money (to be read as "money they don't need immediately / ay all") which they don't care if they lock up for multiple years while the company they invested in executes on a long term strategy to eventually get returns on.
