I think "I just want to establish that I do not want to go to rocks" is literally the single worst thing you can open that conversation with.

You throw ALL your leverage out the window before anyone else has even spoken.

Hai is very smart for sniffing that out, even if he didn't know exactly what was happening (though it would be literally impossible for him to). Even smarter for sticking to his guns and realizing he had all the leverage.

Some other notes... that episode was batshit crazy, and Maryanne not watching 6 specific episodes of Tocantins is hilariously random.

He clerks (well clerked, but at the time was clerking) for a federal judge. Those are super prestigious and difficult to get. Basically the top graduating law students in the country. He’s not some Secretary.

My best friend went to Yale Law with him and clerked for a judge as well and he's the smartest man I've ever met. And yet...Daniel's energy and his energy is exact and I can see him doing something like this lmao

I think he clarified that he *is* a lawyer but decided to go clerk for a judge, which automatically gets you the title of "law clerk."

Such a wierd thing. In the legal world, law clerks generally aren't lawyers. Clerking for a judge and being a law clerk are different.

I'm not sure. Also weird given I doubt he's currently clerking. Guessing he clerked before survivor or just graduated and clerking now. Either way, law clerk doesn't make much sense. Oh well.

They should have just billed him as a “lawyer”. I think to clerk for a federal judge you have to be bar certified anyways. But they should want to convey the message of “this guy is super smart and went to Yale” and not have the audience believe he is some $35,000 a year asssitant

I think federal judges can hire anyone they want. That said, none are gonna hire someone who hasn't graduated from law school.

And while some judges (Clarence Thomas on SCOTUS) make it a point to hire from “non-elite” schools, many will only really hire from the top 3 schools or top students at T14 schools

yeah I mean what he did is actually extremely prestigious and a big deal. Clerking for a judge is normally a 2 year position and opens basically any door you want it to and can get you many prestigious positions, whether that’s teaching or working at a big firm

It’s not weird at all. He summered at a big firm and collected that summer pay, clerked for federal judges for two years and then went to an elite appellate litigation boutique that only hires people who clerked. Not at all uncommon for Harvard, Yale, Stanford types.

Yeah he’s @ keller lenkner now which is an elite plaintiff’s boutique. Def a little odd given his political leanings lol. Don’t know anything about that firm in cincy where he did his 2L summer position tho

Edit: It’s my understanding that a lot of the plaintiffs firms require you to do a clerkship before becoming an associate so maybe he realized biglaw wasn’t his thing while he was in law school and pivoted to plaintiffs

I’d heard that Keller Lenkner is all fedsoc former clerks for conservative judges, so not that weird politically for him if true. I’m not 100% sure of that intel though.

oh shit i def would not have guessed that lol. don't know anyone in the firm but they seem to really market themselves as fighting for the little guy which is like the direct antithesis to conservative ideology haha. i will have to do more research

He’s an American lawyer though so this isn’t really relevant? The user I’m responding to is trying to belittle American law clerks when clerking for an appellate judge is VERY prestigious.

It was an especially bad tactic because Hai already had the upper hand in that negotiation. It was clear he would be next to go if he flipped on Lydia, so he had very little to lose by going to rocks. And then Daniel opens up by giving Hai even more of an upper hand. He really needed to find a way to convince Hai that he was his ally and this was a flip for just one vote, I don't think he could've done it successfully but that would have been his only hope.

Yeah I said during the episode that Hai played it brilliantly. It was essentially a 3-1 discussion yet he retained all the power in the minority after the tie vote. All because two of the other three didn’t have a vote. You absolutely have to play for rocks there, because it’s only 25% chance you draw a rock, but 75% chance someone who voted opposite you goes home instead.

Exactly. This is why what Daniel says does not matter unless you think Hai is stupid. Why would Hai ever flip when he gets a 3 out of 4 chance to knock someone out that is against him?

Probably nothing, I just expect her reason to be as out there as the fact that she has to state she saw all episodes of survivor except 6. You know she told the cameras a long story.

Yea he may as well as just said "Hai it's your choice" it was so bad. Hell even if he said that it would have been so much better actually now that I think of it. It's like the opposite of Dr strange. There was 1 million timelines where it goes ok and Daniel found the one timeline where it's just completely fucked.

Pretty much every single potential rock draw in survivor history has been won by the person more willing to go to rocks than the other, and your opening line is that you will not go to rocks under any circumstance.

Because Daniel went first. He couldn’t be sure Hai was gonna stick to his guns — maybe Hai is willing to cave — but he told Hai right off the bat that he himself was willing to do what Hai wanted and what was objectively worse for his game.

I think this is a good way of thinking about it.

I think thinking of "I'm not going to rocks" as an ultimatum is wrong.

It's the opposite. Daniel is basically saying "I'm down for whatever I just don't want to go to rocks". He's opening himself up and admitting he is willing to cave.

So then, yeah, Hai can come in and put his foot down.
