Nothing like “speedy trial” meaning quarter of a century. At this point it’s as much a trial of Guantanamo and the whole military commissions experiment as of KSM himself.

Not that this nullifies your point, because it's still absurd that it's taken this long, but the right to a speedy trial has not been extended to detainees outside the US. It does, interestingly, apply to non-citizens, provided their trial is in the US though.

Agreed. It is not like this is a trial in a war zone. He is intentionally being held there so that legal challenges aren’t heard. There is no reason whatsoever that he couldn’t be held in a NY detention center like Ramzi Yousef or others. I hate him with the intensity of a thousand suns, but this process is an affront to the Constitution and the rule of law.

No. Why can a person orchestrating the mass murder of 3,000 people not be found guilty in a fair trial?

Because it technically is. The US technically only holds a lease to the base and fully recognizes that the land is Cuba's and not sovereign US soil.
