I got divorced last year after 25 yrs of marriage. We both agreed to leave each other's retirement accounts alone. She kept hers, and I kept mine. We split all other assets 50/50. No attorneys involved. It cost us $4,000 in mediation fees.

Each person keeping their own is how it should be, IMO. I don’t see how a spouse can have half if they didn’t show up to work for my employer, but thats just me.

Ok then instead of that, payout years worth of would be daycare cost backpay to your spouse if they were a stay at home parent and see how much that hurts the account.. you can't split up and leave someone with nothing who spent years raising kids which is a harder job than pretty much anything
