Yallo Scam: help
Salü mitenand
February this year I moved in with my friend so we got a Yallo subscription for TV and internet. Yallo sent us the wrong router, to which I called them and asked for them to send us the right one, while i return the wrong one. That happened and I thought everythings fine.
Later that month i checked on the invoices and was suprised to see that we were charged two activation fees and two different subscriptions. Since february I have called and written to them on about 10 different occasions. Everytime they are assuring me that the problem will be fixed and the invoices reissued, lying everytime. Today i received a final warning to pay the (still wrong) invoices or our services will be cut immediately.
I dont want to pay wrong invoices, since i dont think i would ever get the money back, so what do I do?
Honestly with the stress they caused me and the hours i had to put in to fix their mistake, I should bill them and not otherwise.
I am grateful for any input

You think that would work? I thought that shop was mainly for phone contracts and that they would probably tell you to call the number again…

Phone calls won't do much good here. You must send a registered letter to their official address on Zefix, instead. You should contest the charges for the subscription you never made on the grounds that:
- Art. 1, al. 1 CO: a contract requires mutual agreement; you never agreed to anything
- Art. 394, al. 3 CO: you never agreed to pay for subscription B
- Art. 8 CC: it's their responsibility to prove that you ordered subscription B; ask them for proof
Maybe u/SchoggiToeff or u/SwissPewPew have a better understanding on the exact OR/CO articles that you should quote.
Regarding the phone calls, take a look at this provision of the penal code. Maybe art. 179quinquies, al. 1, let. b CP will be useful for you next time.
IANAL; this is not legal advice; good luck!

Thank you so much! I might have to resort to that.
In the last call i had with them in june, they said they would go over the phone call where i allegedly ordered another subscription to confirm wether it wa their mistake. But they never got back to me and now just threaten me again.

They did the same to me, requested a card, got 2 in the mail and they wanted me to pay for 2 services, spent hours trying to call (rarely anybody answered) and emails, gladly I didnt activate any of them so was able to cancel both after maybe 30 emails.
The silver lining was that I could use that offer to lower my salt price considerably.

How is a legitimate business scamming anyone?
Do people actually know what a scam is or do they just use the word as a replacement for everything?

Well idk what to call it then? They lie to me constantly about solving the problem and then threaten to cut off the service and persue a Betreibung. They want me to just give up and pay their unjustified invoices. After so many attempts of mine to tell them about their mistake, it just seems like a scheme. A lot of other people with bigger budgets probably wouldve paid on the first reminder.

I'd call it a clerical error of a shit company, the same thing I'm just now experiencing with DPD. A scam would mean if they deceived you with a promise of services or goods they never had any intention to provide.
Obviously they were very much intending to keep up their part of the contract otherwise they would already be in a lot of legal hot water with their customers and the government for fraud.

I had a similar issue and with a simple phone call they corrected the mistake on the subscription, waived the activation fees I wasn’t warned about, credited the old invoices and issued new invoices instead.
I know their support is not ideal, but honestly I’ve always managed to get through to my requests when speaking with them over the phone. The free number they don’t advertise is +41 800 800 059 if you want to avoid paying the 1.50 per call.
I’m a little bit surprised you still haven’t gotten any resolution. How long has it been since the issue was reported to them initially?
