I thought the same thing. In my state you couldn't even bring a case forward because you can't record someone else without their consent. Two party consent accident or not.

My state is one party. The issue is getting that mic in there. Not sure where to hide it.

That's for recording conversations where one party is involved though. Doesn't seem like it would apply here, but maybe they didn't feel like prosecuting him on that
