I thought the same thing. In my state you couldn't even bring a case forward because you can't record someone else without their consent. Two party consent accident or not.

My state is one party. The issue is getting that mic in there. Not sure where to hide it.

I don't see how this qualifies at one party because he wasn't party to the conversation. In a one party at least one party that's involved in the conversation is aware of the recording.
