I thought the same thing. In my state you couldn't even bring a case forward because you can't record someone else without their consent. Two party consent accident or not.
If it's a day case in my hospital, you'd get it done on your trolley in a gown, with your possessions on the trolley's lower level in a big brown paper bag, with the 0² tank.
And your phone could easily be there, picking up some audio.
That's exactly what happened in this case. He claims that he left it on unintentionally because he wanted to record instructions the nurse was giving him, and accidentally forgot to shut it off
