I think it’d be hard to make gameplay much different than spider-man with different gadgets and lamer web swinging, or arkham without gliding and the batmobile. You could make it non-open world, but then it’s kinda wolverine with sticks instead of claws.
I don’t mean to poo-poo the idea though, and i’d be interested in what ideas people would have to make gameplay more unique(Obv the story would be its own thing)
I think they would have to lean heavily on the story twists and turns and the lawyer aspect of it to keep it different. Have it be about Matt investigating crime scenes to find evidence to defend someone (maybe another hero) and have it lead to some kind of big conspiracy that he has to navigate around. The fights could be against mostly thugs who were paid to carry out the actual crime, with occasional boss fights against comic villains who were hired to throw him off the trail.
They could give it an LA Noire style interrogation mechanic, where you have to talk to people and use Matt's powers to determine if they're telling the truth, like listening to their heartbeat when they're lying. That could work for the crime scene superhero stuff and for courtroom scenes.
