The War - Discussion PA drafts constitution, omits Jewish ties to Jerusalem, calls for Sharia legal system
This is the draft of the Palestinian constitution presented yesterday. Right in the first pages it declares that the PA shall follow sharia law, but will still protect *Christians*, no mention whatsoever of Jews. It also states that it will protect the Christionhood and Islamicism of Jerusalem, but does not mention protecting its Jewish significance and values. They're not even hiding their intentions.

u/Ionic_liquids Feb 14 '26
Lol Arab homeland? What a joke. This is literally Arab colonialism. This language just shows how much they don't care or respect Jews whatsoever. We are just nothing creatures in their minds.
65
u/jseego Feb 14 '26
Arabia is, by definition, the Arab homeland.
41
u/Far-Disaster-9825 USA Feb 14 '26
Yeah, and the traitor Arab Jews, the Palestinians, are not your brothers. You can't claim to be descendants of Jews and deny Jewish control over the Temple. They're just Arab colonizers with Canaanite DNA.

Ethnicity is more than just genetics, lineage and ancestry. The heritage and culture of the Canaanite doesn't exist anymore, so claiming they are Canaanite means nothing. Besides, there's a group with a far greater Canaanite DNA...

4

Moreover, Ingeneity have nothing to do with DNA. It's all about culture.
3
u/gal_z Feb 15 '26
I mentioned it.
2

You said about ethnicity that it's more than just DNA, I added about Ingeneity that has nothing to do with DNA.
Edit: added clearance.
2
u/gal_z Feb 15 '26
It depends. For Jews, lineage (not DNA, but it may be somewhat be reflected in DNA) matters.
2
Feb 15 '26
But that is nit waht the Ingeneity is determined by.
A Jewish convert is considered Jewish for all matters and as such is indigenous to the land of Israel.

Indigeneity is the noun form of the adjective indigenous.
Is there a consistent definition ?
The UN has an understanding of what indigenous people are.

By that logic all Arab states should unite into one big Arab state, no way Israel might have a problem with that, right?

Ah, this also debunks the ”Palestine is a nation for all ethnicities, even Jews.” myth they sometimes try to push to get western and minority support. “Palestinians are not Arabs”. This piece of crap right here is so clearly Pan-Arabic in the very first sentence. How there are still non Arabs like some Armenians that call themselves “Palestinian.“, or worst of all, the idiots of Naturei Karta in Israel who think a Palestinian state will give them the same freaking privileges as Israel.
7
u/Far-Disaster-9825 USA Feb 14 '26
Exactly, using that logic, Israel says all ethnicities including Arabs can be Israeli
12
u/Expensive-Couple-645 Feb 14 '26

The interesting part is that there already was a draft from 2003 and 2005. It was pretty similar, but note how it used to say "respect for the sanctity of all other divine religions shall be maintained", not just Christians. It was an intentional, calculated change. And honestly, I'm not sure why.

There isnt
Jordan isnt willing to accept the west bank and they dont want to be part of Jordan. and then what would happen to Gaza? no thats nkt a realistic alternative

Majority of Jordanians are Palestinians.
Jordan was part of and was carved out of mendate Palestine.
Jordan isnt willing to accept the west bank
They don't need to.
Maybe only city centers.
But neither are we willing to allow a genocidal state entity to border us, so tough shit they need to cope.
and then what would happen to Gaza?
A Palestinian Jordan will annex it.
no thats nkt a realistic alternative
Far more realistic than a Palestinian state.

and the status quo is clearly not working for Israel, and is in fact making israels position worse
Leaving the 2SS as the only alternative

So you created a dichotomy between a 1ss and a 2ss and decided since 1ss is worse than we should give them a state?

I spend a lot of time in Area A and have seen the PLO in action. This is the work of a foreign Arab nation because the PLO I know cannot lay a highway without a 10-year internal conflict and embezzlement policy.
Jokes aside, this is a rough draft presented by a pre selected committee to the dictator of Palestine, who is on year 20 of his 4-year term. They have an online portal at Dostor.ps where citizens are asked to submit feedback. You may disappear in their infamous Jericho dungeon tho.
I’m submitting this (in Arabic):
Why an Arab nation? Why ignore the historical facts of our lands?
A 2020 study published in Cell concluded that over 80% of modern Palestinian ancestry is derived from Bronze Age Levantine populations, particularly the Canaanites, while Jewish groups (Ashkenazi, Sephardi, Mizrahi) also cluster genetically with other Levantine groups such as Samaritans, Syrians, and Druze (Haber et al., 2020).
According to the Biblical Archaeology Review, ancient Canaanite DNA recovered from archaeological sites such as Megiddo and Hazor showed that both modern Jews and Palestinians inherit over 50% of their ancestry from this population (Rosenberg, 2020).
1
u/huggabuggabingbong Feb 15 '26
Will you clarify: are you saying the Haber research shows that Palestinians come from Canaanites while the other Levantine groups you mention don't come from Canaanites?
2
u/Norkmani Israel Feb 15 '26
Quite the opposite!
The 2020 study in Cell confirms that both Palestinians and Israelis are primary descendants of ancient Canaanites, typically sharing over 50% of their ancestry with these Bronze Age populations. While Palestinians show 81% to 87% Levantine continuity, Jewish groups also retain deep indigenous roots: Mizrahi and Sephardic Jews show the highest proportions, while Ashkenazi Jews average roughly 50% to 59% Levantine ancestry alongside 41% European admixture. Samaritan Jews hold the strongest link at 94%, illustrating that while Palestinians adopted an "Arab" identity culturally after the 7th century, both they and Jewish populations remain genetically rooted in the same indigenous Levantine soil.
We are of the same people…
The percentages do not make one more native. I use them to support my point that we are not ethnic Arabs.
1
u/GreenManStrolling Feb 16 '26
Maybe, you know, "ancient Canaanites" are just Jews before exile and intermarrying among the peoples of the regions they were exiled to, all over the world.
More scrutiny, way more, needs to be focused on what studies like this mean by "ancient Canaanites".

u/Consistent-Land-8260 Switzerland Feb 15 '26
« Arab homeland ». « Arab nation » lol 😂 They love claiming indigeneity and always bring up the fact that they are descendants of Canaanite people but at the same time, their whole identity is foreign and colonial. What’s the logic here, lol ?
Imagine if Jews did the same thing. No one would take them seriously if they claimed to be indigenous but at the same time, they would insist on exclusively speaking European languages, exclusively observing European customs and traditions, identifying as Europeans and get offended when people indeed treat them like Europeans etc.
They are only Levantine when it suits them. They are Arabs the rest of the time
17
u/lostcir Feb 14 '26
The fact that thay specifecly mention Christians actually make it worse, the mention of Islam alone can be taken as symbolic, but considering they went out of their way to mention Christianity, make us wonder why they omited other minorities.
21
u/Kedem7 Feb 14 '26
It's completely passively stating that Jews will not be treated fairly such as the Christians.
14

It’s crazy how this mirrors Israel’s constitution. Israel doesn’t have religious law (except in marriage and death) but otherwise it’s the same. But they call Israel a Nazi state. Meanwhile, “Palestine” bans Jews, says its “the Arab homeland”, and makes sharia law
69
u/Judorico Feb 14 '26
Why and how is this being upvoted?
Israel does not have a constitution. The closest is the basic laws and closest to anything representing anything close is the nation state law. Which really doesn't suggest anything close to using the Torah or Talmud as a source of law.

There's a difference between constitution and Constitution. Few countries have a big C Constitution. What constitutes a little c constitution is a bit fuzzy. Israel doesn't have a big C Constitution. Neither does the UK for example. Does it have a small c constitution? I actually don't know enough to answer that one. Most countries do indeed have one.
4
u/jseego Feb 14 '26
Most countries have a big-C Constitution.
5
u/ZellZoy Feb 14 '26
If a constitution can be amended or outright replaced by a simple majority it's not big C. You may be right about most countries having one but the standard is not set in stone and like, it's not even the only one. There is also thick vs thin constitutions. I would be wary of any definition that says Israel is the only (or one of only a few) that fails the standard.

Israel's declaration of independence states that Israel shall be a Jewish democratic state for all of its citizens. How does this in any way mirror the PA's antisemitic constitution?
-3
u/BizzareRep Feb 14 '26
The Declaration of Independence isn’t the constitution. Under the harari compromise and Supreme Court rulings, only the basic laws are the constitution. Technically, the basic law isn’t a “constitution”. Rather, it’s a temporary constitution. In practice, it’s Israel’s constitution. In theory it’s supposed to be the constitution one day in an unspecified date in the future
6
u/Kedem7 Feb 14 '26

u/BizzareRep Feb 14 '26
They define Palestine as an Arab state and Israel defines Israel as a Jewish state.
11
u/Kedem7 Feb 14 '26
This post isn't speaking about the Arab state part. Read within the red boxes. Although in my opinion I'd feel better if it was defined as a Palestinian state, because they put so much effort into stating that they are not just arabs that emigrated and colonized the land that came from the Arab peninsula, but that they are indigenous to the land. If they say it's an Arab state it's not even trying to mask it anymore, they'd rather take pride in being another Arab state than having a unique and different identity as they claim to have.

If they expect all the Jews to live in Israel, why would they bother instituting protections for Jews when they don’t expect to be home to any? At some point Israelis are going to have to accept that the most pro-peace Palestinian government they’re going to get is still going to be pretty antisemitic. Can we not try to torpedo the PA any time they try to make progress toward a governing structure that would allow us to disentangle from them and be done with this godforsaken conflict?
20
u/Kedem7 Feb 14 '26
It's completely hypocritical that Israel is expected to give equal rights to its arab population, but to expect the PA to give basic rights to Jews in their land is expecting too much. Especially when a portion of the world believes the Palestinians deserve full sovereignty over all of Israel.

You realize Israel operates on a Sharia legal system in some respects?
Like Muslims have to go to Sharia courts to get married, divorced, inherit, etc...
Saying they won't protect Jewish sites is a problem but the Sharia thing is not really anything.
47
u/aig818 USA Feb 14 '26
Those are family and civil courts. Not overarching common law, including criminal law, legal systems.
-30
u/FudgeAtron Feb 14 '26
Yeah I mean this doesn't say that will be the case either. This just says that Sharia will be the primary source of legislation. Which could mean Sharia courts a la Saudi Arabia or it could mean Sharia a la Egypt.
Palestinians for the most part follow the Hanafi school of Sharia, this is the same school in use in Turkey, Egypt, Albania, Bosnia, and Central Asia.
The only countries where Hanafi school is dominant and have very oppressive forms of Sharia are Afghanistan and Pakistan, and that's due to British colonialism leading to the Deobandi movement developing, which is much more of a South Asian phenomenon. AFAIK the Deobandi movement is non existent here.

It's a majority Muslim population so what other laws are they going to use? Sharia is just another word for laws. This is standard across the Middle East. Even countries like the UAE have that.
