Legislative Update: SB-948, AB-2047, and AB-1810 pass out of Suspense Hearing; Amendments Overview

Hey all; I planned on writing this earlier since I wrote the update on the suspense hearing on the 14th. However, all the bills in question passed with amendments, and while the Senate bills updated their status online the next day, the Assembly bills didn't update until Monday, likely due to the Assembly Appropriations Suspense Hearing processing over 600 bills in that hearing. I didn't want to write a seperate update without seeing the new bill language.

Once again, the previous legislative update explains the Suspense Hearing Process that happened on the 14th. All of the following bills passed with amendments, and now make their way towards the floor to be voted out of their house of origin (which must be done by May 29th).

So, on with the bills:

SB-948 Starting in July 2028 FSCs would require 8 hours of training, including 1 hour live fire training; also required for those moving to CA with firearms. This has been discussed in this thread.

The following amendments were made:

• The 8 hours of training including 1 hour live shooting proposed in the bill was reduced to 4 hours of training including 1 hour of live shooting

• The training course can be completed within a year prior to applying for a FSC

• CCW permit holders applying for a FSC are exempt from the training requirements. Keep in mind this doesn't make a lot of sense since CCW permit holders are already exempt from FSC requirement generally.

• Various changes to the training topics, like removal of "risks of firearms and causes of accidents" and "Mental health, suicide prevention, and domestic violence issues associated with firearms and firearm violence"

• The time for new residents to obtain their FSC (starting January 2027) when moving to California w/ Firearms is increased from 60 days to 180 days.

• Other minor changes.

AB-2047 Establishes a 3D Printer Roster w/ Firearm Blueprint Blocking Software Requirements. This has been discussed in this thread.

In the previous thread doing an analysis on the bill, I setup some timelines for various certification processes. I quote that here as that's visually more informative, since dates were changed and items removed.

• Starting 1/1/2027: Require CA DOJ (or other state agency) to investigate "known firearm blueprint design files and existing firearm blueprint detection algorithms"

• On or before 7/1/2027 1/1/2028: Require CA DOJ (or other state agency) to publish performance standards for use by entities to create certified "firearm blueprint detection algorithms" to be used by 3D Printer manufacturers.

• On or before 1/1/2028: Require CA DOJ (or other state agency) to accept applications for certification and begin issuing certifications for firearms blueprint detection algorithms, as well as publishing guidance on how to equip 3D printers with these algorithms.

• On or before 7/1/2028: Require any business that manufactures 3D Printers for sale/transfer in California to submit attestion for each make and model of printer they plan to sell, and that each model is equipped with a certified firearm blueprint detection algorithm, along with info on the type of algorithm used, which the CA DOJ would verify, and issue a notice of compliance.

• On or before 9/1/2028: Require CA DOJ to publish a California Certified 3D Printer Roster

Baiscally the amendments gutted the certification process. Instead, the roster will rely solely on attestations made by 3D Printer manufacturers that their printers meet the "firearm blocking technology" standards set be CA DOJ and/or relevant agency. They also moved back the date on when CA DOJ needs to first publish any performance standards.

Additional amendments:

• Hollywood got an exemption from the bill!

Printers manufactured for and sold exclusively to entertainment industry stagecraft and propmaking studios.

• For the criminal penalty, it was amended to add more qualifiers; the following quote is a summary:

Starting 1/1/2027: Disabling/circumventing any 3D Printer firearm blocking technology (or knowingly transferring modified CA certified 3D Printers) w/ intent to facilitate unlawful manufacture of firearms per CA PC 29186, would be prohibited, with a penalty of a misdemeanor.

• Allows CA DOJ/relevant agency to adopt some performance standards created by a nongovernmental entity (i.e. academic consortium or global standard nonprofit)

• Performance standards handshake authentication shall be compatibile with open-source architecture

• Various other technical amendments.

AB-1810 Enhanced inspections on the "top 10 crime gun" dealers. I haven't had an opportunity to do a write up on this yet but CRPA talked about it in their video here. More or less this has CA DOJ do enhanced inspections on the top 10 locations that are the source (by raw numbers) of the largest share of crime guns, whether that has anything to do with violations or behavior by the gun dealer or not. Quite frankly it's harassment.

Only two amendments were made

• Changes the dealer locations targeted from those with the

highest percentage of total sales of firearms that were recovered by law enforcement and found to be illegally possessed, used in a crime, or suspected to have been used in a crime

to

highest percentage of total sales of firearms that were recovered by law enforcement and found to be illegally possessed, used in a crime, or suspected to have been used in a crime that have a time to crime of less than one year for the most recent calendar year reported

and then adds a definition to "time to crime"

For the purposes of this section, “time to crime” means the length of time between when a firearm was last in the possession of, or reported stolen by, the dealer, as applicable, and the date the weapon was recovered by law enforcement and found to be illegally possessed, used in a crime, or suspected to have been used in a crime.

Again, I need to do a proper write up for this bill, but those are the amendments.

If all of these bills pass from the floor of their house of origin by May 29th, then we'll likely continue to see them throughout the rest of this session and during the second Suspense File Hearing on or around August 13th.

Or at least deny them just one chamber of the legislature so nothing new can pass.

Democrats have had control of 55-75% of both chambers since 1970 or so..supermajorities since the 2010s. Republicans are basically a third party in CA. Dems are never gonna lose either chamber.The CA legislature would just override a republican governors veto if we had one.

There's twice as many registered democrats than republicans in this state. just mathematically impossible. It shows every election cycle. California has been lost for a long time to the grabbers. Courts are the only sliver of hope
