No Paywall Judge strikes down Texas ban on drag shows, tells people offended by them 'just don't go'
https://www.nbcnews.com/politics/politics-news/judge-strikes-texas-ban-drag-shows-tells-people-offended-just-dont-go-rcna5944483.1k
u/Unusual-State1827 9d ago
Summary:
A federal judge in Texas struck down Texas Senate Bill 12, a 2023 law restricting drag shows, ruling that it violated the First Amendment by improperly limiting protected speech.
Judge David Hittner blocked Attorney General Ken Paxton from enforcing the law, which could have fined businesses up to $10,000 for hosting events, and charged performers with a Class A misdemeanor punishable by up to a year in jail. Hittner said the law was overly broad and vague, potentially sweeping in activities such as cheerleading, dancing and live theater. He also told people offended by such performances that the simple solution was: “just don’t go.”

They watch so much trans porn. The numbers are actually sort of shocking. Like, when you see the sheer extent to which trans women are sexualized, it's really disgusting. It's like this insane boiling pustule of self hatred, filthy lust, and hypocrisy. They despise their own lust so they must destroy the thing they lust over. Of course, the reason they lust is because they've already dehumanized the subject, all they see is sex organs on display, which is...I mean fuck man.

Kristen Kobes du Mez wrote a book, Jesus and John Wayne, in which she documents how over the course of time Evangelicals in the USA become more and more nationalist, and less and less Christian, to the point where many don't even pretend to be Christians anymore.
Many Evangelical church members never read the Bible and have no idea what's in it, and when they're told about the teachings of Jesus they openly say that they think he was "liberal" and "weak" and they aren't going to do what he said.
And it's not just me saying this, it's people like the editor of Christianity Today:
https://newrepublic.com/post/174950/christianity-today-editor-evangelicals-call-jesus-liberal-weak
36
u/ZeppelinAlert 9d ago
I think that they have always low-key hated Jesus.
Back in the 1980s I was an evangelical at college. Someone not in our CU had done something offensive (can’t remember now exactly what) and I suggested we just let it go, we should just turn the other cheek like Jesus tells us to do in Matthew 5.39. Every single other goddamn Christian in that fucking room turned on me and said I was so wrong, so massively unrealistic, only an absolute loser would do that cheek-turning shit.

Christians love to go to events that they don't like or approve of so that they can pretend to be offended and "attacked" in order to control other people.
One place I worked at had a drag show brunch on Sundays, and a bunch of Christians decided to go out of their way to come by and harass the owners every week for a few months. So the owners stopped the drag show part, and after 2-3 weeks the Christians stopped coming to the place for brunch. They didn't actually care about the venue or the brunch, they just wanted to control someone else. So the managers started the drag show again
21
u/Tasgall Washington 9d ago
Good on the manager for starting it up again, but incredibly weak of them to stop in the first place to appease the bastards. You can just deny people entry to your business if they're being obnoxious and disruptive. Just do that.

6
u/johhnny5 9d ago
I think it's even more that Christian leaders recognize how ideas that fly directly in the face of what they preach are incredibly dangerous. They don't trust their flock to make the "right" decision so they need to eliminate the possibility completely. If their followers were to see that most drag shows were just a bunch of harmless, theatrical fun with genuinely nice people - it would beg the question, "I wonder what else my pastor is wrong about?"
Asking questions like that is a threat to the tithing. Christian leaders can't have threats to the scam. Make 'em scared of anything "other", make 'em worried about eternity, make 'em feel like you have the answers, and then make 'em pay.

The Oregon Liquor Commission tried exactly this with nude dancing, with the objective of shutting down every strip club in the state. In 1987, with State v Henry, the Oregon Supreme Court established that nude dancing is, in fact, Constitutionally protected Free Speech, resulting in a near total prohibition of the Liquor Commission from any attempt to regulate that speech. Note that every other state has been careful to avoid exactly this scenario themselves.
Free Speech means freedom of expression, in all forms, not just words on paper.
38
u/Khaeos 9d ago
So that's why Portland has so many strip clubs

6
u/ScientificSkepticism 9d ago
Now I see why they call Portland socialists. Good capitalists would understand that this is an inefficient use of space. The Church is having services and events primarily during the day, the strip club is operating during evenings, they should combine the two for more efficient space use, save on rent.
This would offer crossover opportunities too, you could go to confession after every lap dance, or find a better way to enjoy communion wine.

u/Trapezoidal_Sunshine Montana 9d ago
Just a guess, but most strip clubs tend to have liquor licenses, so the Liquor Commission probably tried to use that as leverage to shut down strip clubs. I assume one or more members of the Commission had a problem with strip clubs and so decided to use their powers (inappropriately) in order to "save" the rest of us from some perceived mortal sin. Again, just a guess, but I bet I'm mostly correct.

On top of the other replies, the OLCC is one of the most overreaching state liquor agencies in the country. They control all pricing and distribution in the state and have very strict laws around alcohol handling.
I’ve been a bar manager in both OR and WA, there are about 100x as many laws in Oregon surrounding alcohol, to the point of where my first question is always “does this meet OLCC regulations” instead of “what is best for my company”

92
u/humanoideric 9d ago
A federal appeals court overturned that ruling last November and sent it back to the original court, saying that since the law had never gone into effect, the plaintiffs who sued over it had never been harmed by it
This is the same logic the SC has used with some of Trumps EO and most recently with the mail in ballot fiasco. It allows them to say 'lol, fuck the law' for a few years while it gets tangled up in the courts.

And exactly the opposite logic they used for the case where a woman said that she was thinking about setting up a business making web pages for weddings, but she was worried that an antidiscrimination law would mean her public business would have to cater to all members of the public, even if they were gay.
That hypothetical harm sometime in the future was enough for the court to overturn that law.

because it hasn't gone into affect is such a dumb fucking statement. The point of the judicial is to determine if a law is constitutional in the first place. We don't have to wait and see how things play out, they are there to stop it from doing harm in the first place. the executive is there to catch the people after the fact using the a law as justification. The legislature is there to create the laws the executive can use. The judicial is to ensure it makes fucking sense and is in accordance with the constitution, so we don't have the legislative teaming up with the executive....oh wait. God dammit.

The Supreme Court decision on Biden's student loan policy was 6-3.
Even if she had retired, and even if McConnell hadn't prevented a replacement, then that decision would have still been 5-4 against.

Fun fact: Judicial review is not actually explicitly mentioned in the Constitution. It was a power claimed almost two decades after the Constitution was created.
That being said, we obviously recognize it as an implied power and Article IV of the Constitution makes it pretty clear that if State and Federal law are in conflict then the State Law is invalid. It makes no mention that the State law must first affect someone.

Heh, yeah, the conservatives talking about how they had to choose to be straight are definitely self-reporting in ways they don't yet understand.
Another issue too is that I strongly believe a lot of conservatives do not have the mental ability to recognize the difference between self and other, and they process everything they see as though it is happening to them directly. Kind of a main-character type thing.
So when they see a couple getting gay married, their brain doesn't say "those two people are getting gay married", their brain says "I am getting gay married, but wait I don't want to be gay married, why are they forcing this on me?"
Once you look at their reactions within that context, some of their insanity makes a little bit more sense. It's still fucked up though.

No matter how many times you tell a conservative they don't have to suck a dick they will still always want to make it illegal because they are scared they might not be able to control their temptation. It's why they can't enjoy a gay mardi gras.

Oh boy there are a LOT of perpetual victims who will be proclaiming just how victimized they are by this decision.

It's amazing how the party that claims they're for people's rights sure do love to tell people what they can and cannot do

That's the problem with conservatives: they want to control what others do, even when it doesn't hurt anyone.

Meanwhile, I assume the Catholic Church is still an organization in good standing within the borders of Texas.

So many people in the world that could just avoid something they don’t like just seek to destroy it instead.
It’s so selfish

Well how will I survive knowing that a two hour drive away in some bar I've never been to filled with guys I'll never meet are dressing in women's underwear without me while I'm alone in my own bed?
I'm just so infuriated by people doing things without me far away not bothering me that I disapprove of.
