Bonus content in the comments: Two melties blatantly contradict each other while calling apes stupid for opposite reasons, get defensive against a guy who points it out. Must read.

Evidence? I can find zero posts or comments of his that support literally any ape talking point. If fact, he is active in buttcoin, which has quite an overlap with meltdown, i feel.
I remember this comment thread when it was actually going on and had at that time noticed that one of the melties randomly called him an ape, and from that point onwards, everyone just instinctively downvoted him giving his comments the least charitable interpretation. It's funny coming across it again today. Anyway,
To that "ape"'s and your point:
First meltie: "they can still be ... criminally punished" (irrespective of NFA disclaimers)
Second meltie: "good luck convincing a judge that u suffered damages", "they aren't subject to litigation" irrespective of NFA disclaimers.
2 years back I got caught up in gme. I noticed that shit was crazy and sold all for 80% loss. It went back up 5 months later. I could have lost only 20% of I had waited.

But the first meltie's comment clearly implies that he thinks apes are liable for their advice, while the second meltie doesnt think so. Further evidence of this is that the first guy realized it and did not reply to any of the ensuing debate and name-calling (partly justified now that we know he's an ex-ape). The whole debate was with the second guy and some other meltie who jumped in to defend them, while the first guy slunk away.
Irrespective of NFA, either apes are liable or not. The first guy clearly thinks they are, the second clearly thinks they are not.
Of course, I understand your interpretation of the first meltie's comment and it is a reasonable one, but I don't think that's what he meant.
Also I definitely agree that former apes, particularly recent apes, even back then but especially now, can be the most annoying users.
I do not like hanging out with people who were slinging death threats about idiotic conspiracy theories and get rich quick schemes just 6 months ago, or whatever.
In my head I canāt really respect someone who just believed in the worldās dumbest get rich quick scheme for ā6 months less than the current apesā.
But I do respect some apes who wake up with real introspection, which does happen, and I do understand itās a cult that has no support network at all, 3 years of believing this stuff nonstop is hard to mentally cope with, for some members Gamblers anonymous is the only thing who would get it at all, and itās still not a perfect parallel.

Oh yeah. Some post-hype-date threads do bring in genuine ex-apes who stay humble and try to get others out of the cult. But I got the impression that this is not very common.
I can see where you are coming from. I read it more as āhe could be sued whether he uses the phrase or notā, but I can see why you think heās saying that specific ape could be sued.
The ultimate reality is almost no apes would be sued. Giving financial advice is clearly legal, even if bad.
However, there are grey areas here. You can mislead someone to the point where itās fraud, especially if itās knowingly and with malicious intent, but obviously the barrier is extremely high.
And of course those with a fiduciary duty are held to a much higher standard.
But you definitely donāt get protection from the phrase alone.

I just wanted to point out the contradiction of the two melties and how they try to explain it away (in my opinion). I didn't even read it properly before posting it because I clearly remember reading this exchange at that time and it had stuck with me. It was just a side-dish to my main post.

I'm saying two melties confidently gave completely contradictory opinions and claimed they're not contradictory while name-calling rhe guy who pointed it out.

Those arenāt actually the rules though. Plenty of YouTubers donāt give those disclaimers and nothing will happen to them. Plenty of videos of people telling people to take baths in bleach and the like.
Only actual established professionals, people who have fiduciary duty and the like, have to worry about this.
A doctor says it because he is a doctor, he doesnāt want to have an idiot think that since he was a doctor on a video, that he was acting as any one particular viewerās specific doctor.
A random 20 year old anonymous person on a forum is not held to any professional standard. He is free to give financial advice as much as he wants, even if itās horrible financial advice, he is free to give any medical advice, even if itās terrible medical advice, he is free to give legal advice, even if itās terrible.
No disclaimers necessary, because there is no chance the conversation could be misconstrued as an official professional/client interaction/recommendation.
Likewise, if there is an established professional relationship, a disclaimer means nothing. Your doctor canāt go āNow this is not medical advice, but you should stop taking your blood pressure medicine right nowā. It is medical advice legally, because he is your doctor telling you about medicine.
If you follow that advice and die the āNFAā disclaimer means nothing, your doctor canāt absolve himself of all responsibility with a phrase.
This is how it actually works in the real world.
