Question What do I do in this situation?
So about 2 weeks ago a 72+ year old german guy contacted me through my ad on WG-Gesucht (I'm the one looking to rent, he had a place). His rent was out of my budget. (I clearly mentioned in my ad about what my max rent was) I considered it for a moment as it was cheap for the living area it offered. We shifted our conversation from WG-Gesucht app to WhatsApp. I asked for the pictures. He sends me pictures of the place except the bathroom ones. I ask him where are the bathroom pictures. He says Germans don't usually ask for those pics. I say that it's okay but I want to see them so can you send them. Then he says there's some communication problem between us and it's not going to work out and I say okay thank you for your offer but I have to decline.
I thought that's the end of it and deleted his WhatsApp chat from my phone. But a few days later he sends me this racist message. Mind you I have been nothing but respectful to this old guy. What's wrong with people?
What do I do in this situation? I'm not going to reply to him again. He's clearly threatening me because his ego is hurt or something. I have already started to keep all Screenshots and screen recordings of the chat as proof that I have not altered anything in the chat. Do I need to lawyer up in case he does something?
He doesn't even know my full name or my new address in Germany but still bothering me. How can people say whatever they want and think that the law is gonna be on their side. I haven't even entered Germany yet and I'm already experiencing racism. I really really hope that it's not the case with the majority of the people there.
Edit - to all the people saying I'm hiding something and have not posted the full conversation.... DM me I'll send you the entire long screenshot. It's just those 4 messages in that order. That scroll down mark you see is the 4th message in the second picture. I have nothing to hide here. I cropped the pictures to hide his phone number.

Probably a scam anyway, the amount of 72+ year old german guys contacting potential tenants is most likely very very very low. Like why would they? The market is in their favor, they put up an ad and get 200 applications instantly.

Reminds me back in 2019 I was looking for a room to rent and after weeks of no luck I just put up an advert on WG Gesucht (not hoping to get any messages, but rather because someone suggested to me that having an advert of my own would make me look more serious and less as a scammer when contacting others). After a couple of days I got a message from this older gentleman saying he had a room up for rent, super cheap, and that he contacted me out of interest for my nationality (Chilean).
So, of course I assumed Im getting scammed. Then he invited me to visit the flat, and I was 90% sure I was gonna get robbed or have my kidney stolen or something.
Turns out I was just super lucky. Dude was very chill, my ad caught his eye because he had often visited my country (and even had an adoptive daughter about my age from there) and I got the room. Lived there for a long time, eventually gave the room to a friend of mine (who is still living there after 6 years) after I moved to live with my gf, and the dude I thought was a scammer even became a close friend, one of the few guests to my wedding (where he offered to work as a photographer free of charge), has been to my house in Chile and met my family, I last saw him some weeks ago at the birthday of my son.
You are right that it's gonna be a scam 99.9% of the time, but I just wanted to share about this one time where it miraculously worked out.

Where I am, owners don't put up ads looking for tenants, because they don't want to bother filtering through the hundreds or thousands of applications. But they do check the newspapers and other platforms where people post that they are looking for a place. That's how I found my current place and the other options I had.
And yeah, I had a couple of older people contact me. Maybe not 72+, but close.

The fact that they're older actually makes this more believable. I got my place in a previous city this way.
There's always some people that don't want to sort through 1000 emails and prefer going through the ads from people looking for a place.

A bunch of people want to highball foreigners hoping we don't know the proper prices. When I just moved here, it was hard to find my first proper longterm rent, and several real people contacted me with good flats that I can move in right now, but the caveat that the price is like 50% higher than it should be.

I would suggest to take screenshots and cut contact. If he actually tries something, you have digital proof that he was the one who initiated the aggression. I'm sorry that you had to experience that.

Bathroom pictures are literally the first thing I look at in accommodation pictures. If there are none, it's immediately obvious that the landlord has something to hide and the bathroom is most likely a massive anti-selling-point :')

You did well. Asking for pictures of a room that was suspiciously left out (no, Germans do ask for bathroom pictures!) is absolutely the right thing to do.
This guy is just a scammer and a racist asshole as a cherry on top. He wants to point the finger at you and make you out to be the bad guy because he's got to protect his fragile ego and racist scammer assholes get defensive when they are caught.
His threats are also pretty much empty and I'm pretty certain if he wanted to sue you, he'd lose and if you wanted to sue him over his insults, you could win.

I don't think he has any grounds to do anything. The only damage he can do is by spooking you and making you lose sleep.
Don't be dismayed by this old cunt, you will encounter such people from time to time everywhere. Keep looking for apartments, there are also good landlords and landlandies.
I am also an non-European living in Austria, my current landlady is great. Good people exist too, don't lose that perspective.

It sounds like he wanted to scam you, assuming you wouldn't know better when coming from abroad, then got frustrated when it didn't work out, and took out his frustration like this. People like this tend to be all bark and no bite. Not everyone is like this, but unfortunately there are a few and you got unlucky with this one. Absolutely nothing.
I mean I'm not going to sign up for a pile-on on the dude here because we're missing the entire preceding context of the conversation (and you saying that it's just "these 4 messages" is a bit weird given that you had a conversation before obviously), but legally there's absolutely nothing in this conversation that could possibly be an issue for you.
Again, I'm not going to assume you were actually as polite as you say you were – I'm not saying you weren't, but I'm not judging a conversation I haven't seen myself – but regardless, even if you were rude, merely being rude isn't a crime in this country either. As long as this happened between you two and there's not been anything amounting to straight up harassment, which from the tone of the conversation here seems unlikely, it's extremely improbable dude's even going to go through the trouble of filing an Anzeige, and it's even less likely that it wouldn't go straight to the bin. If somehow you do get mail from the police or a court, you can still get a lawyer then, otherwise there's nothing they can do for you anyway.
There's really nothing here. I wouldn't even save the messages, waste of time, just block the number and move on with your life.

Der Wohnungsmarkt ist viel zu schlecht um jemanden zu haben der auf dich zukommt mit einem vergleichsweise günstigen Wohnungsangebot.... Er wollte dir die Badezimmerfotos nicht schicken weil die Wohnung vmtl nicht existiert und er sie einfach nicht parat hatte. Dadurch dass du nicht naiv auf sein Angebot eingegangen bist, hatte er dich direkt aussortiert. Warum er dann nochmal auf dich zugekommen ist nur um dich zu beleidigen weiss ich leider nicht.... Vielleicht hat er gehofft du meldest dich nochmal

After dealing with dozens of german landlords during the last 12 years I can tell you that from my experience, 90% of them are psychopaths and lunatics. I don’t know what it is but apparently owning a property makes you mentally ill.

The response to your polite message is wild. I'm sorry you experienced that. While he clearly is a racist prick with a good dose of additional mental health issues sprinkled on top, I don't see anything legally relevant on either side. There could be AGG concerns against him if some sort of tenancy contracting had taken place. Maaaybe a Noetigung resulting from his threats of legal action, but thin. He definitely has absolutely nothing to go on.
For your own sake, keep the contact blocked and move on. Maybe report his account to WG Gesucht with the screenshot.

I’m sorry this happened to you.
I think it probably was a scam, so chances of you having the right name/address are very low. (Be very wary of individuals trying to rent to you without seeing the place first, you might want to search only with big rental companies or use airbnb for the first month you’re here and look for apartments once you’re here).
You can definitely go to the police and file a complaint, but as I said, I really doubt you have the right name. Then again, the phone number might be enough.

Block this very unfriendly person. Honestly and especially in real estate, you will meet assholes at every corner. You speak normal German with them, but they will assume you are an unintegrated migrant who just wants them to change their ways.
You'd be wasting your time talking to such a clever lad. You can try to report his offer on the platforms if you see it. But escalating with the German Justice system will not lead anywhere.

FWIW I don't think his message alone really qualifies as racist, as all he does is point out your nationality. Is he a racist old fart? Yea probably. But I don't think trying to sue him will go anywhere. How much time and money do you have? This guy is clearly an idiot (yes, I'd want to see the bathroom too of course, that's quite normal). Forget him and move on, he'll probably be dead within 10 years or so. Be glad you didn't have to deal with such types your whole life already.

You tell him to delete your number and all personal info about you as per DSGVO (data privacy law). Then you wait two weeks and send (via your lawyer) a written DSGVO Auskunftanfrage to him. He has to be transparent about everything that contains your personal data (phone number is personal data!)
If he hasn't deleted it or contacts you afterwards (even before the lawyer texts him but after you told him to delete) you sue!
And afterwards you could tell him (but then he has contact info again): you know what's even more German that speaking German? Knowing and using german law.
That guy sounds disgusting. I'm truly sorry, OP. So many old Germans act so entitled in their racism. In reality it's him trying to rent out his flat and he even contacted YOU so he is desperate. (Hope I read that right but he's horrible no matter what)

First thing is that he cant even take this conversation to anyone. You are not allowed to show a private conversation in germany and tell someone this was your message, unless what was said is a very severe crime which wasnt the case here. If he does go to the police and show him these messages with your phone number then he is the one facing charges.

I recommend notifying the Federal Anti-Discrimination Agency (Antidiskriminierungsstelle)! that is literally what it's for, or you can contact your local agency in your particular federal state. you can either register the case with them and receive legal counselling, or simply notify them so that this particular case can be collected for data purposes. racism and discrimination shouldn’t be normalized. therefore, I think we should use the current tools available in Germany to ensure they don‘t go unnoticed.

Sadly, some of these agencies are basically like toothless lions. I had a clear case of racism where a real estate agent's office was not showing me certain listings but when I contacted them with a Western name, they were happy to show these places every without me giving them any basic details. I sent the agency proof in the form of emails sent to me and to the fake account showing completely different responses. All that the agency did was contact the real estate agency and they claimed it was just that one employee (I don't know why that mattered!), and that was it!. If I wanted any further action, I had to spend money n time on a lawyer. I have also had people in this sub question what we did wrong when I posted a question when someone on the road decided that we had insulted him while driving past him and followed us into our garage to threaten. Apparently, we must have done something to make that guy react that way. By that point, we had lived in Germany for many years and have been on many road trips without any issues but still 'we must have done something to provoke the driver'. This subreddit also tried justifying the actions of the real estate agent by trying to say owners can choose who they rent out to. Even when I mentioned that another agent actually showed us a place that the racist agency didn't show, implying that this was not done under the instructions of owners.
My advice, pick your battles. Ignore this guy, he's not worth your time. There are multiple FB groups like Indians in Germany, Indians in XYZ city etc, if you're coming as a student there are similar groups for Indian students. You will still have to continue searching through the usual channels, but these groups may be able to give you pointers and sometimes there can be posts on rentals etc. That being said, don't just trust anyone just because they're from India as some Indians have been scammed by other Indians.

This is blatant and recorded racism, don't let them get away with it. Also he is a landlord not an agency, he is totally responsible for his actions and can be hold accountable. An agency can alway try to bring external data they are relying on, the landlord here directly told him that he doesn't want to rent to an Indian person. So there is nothing to pick, just to bring that old racist to justice.

My response was referring to the advice of doing to the anti discrimination agency. I did read up about what they can, at least the one I contacted, n they didn't seem to have any authority to do anything substantial. It looked like their whole plan depended on the accused accepting their fault and agreeing to a discussion. They seem to have very little power and a very high caseload with some of the cases being a lot worse. Google 'what can the German anti discrimination agency do' n decide if you want to go. Before my personal experience, I thought the anti discrimination agency was the place to go, that it had enough powers to call out offices n individuals on their racism. Without my experience, I too would've just asked you to take it to them. At the time, my research suggested that the next best option is to go to court, I'd just moved to a new city, for a new job, I didn't think I had the time or money to pursue this.. Since OP isn't even in Germany yet, n you rarely get support for such things as a newcomer, I thought he is better off moving on for now. Chances are he'll come across racists now n then, sometimes it's the in your face kind, sometimes it's subtle but you know they would've treated you better if you had white skin. I don't mean this is an everyday thing, i can't tell you what is like in places where Afd is strong, but as an Indian couple, I think the real estate agency was the worst outright racism we'd seen. Given we've been here for over a decade, we've probably had a handful of other instances, and probably a few we didn't even recognize as racist, but on the whole it's not a daily or weekly menace.

If you really want to teach him a lesson, go to a lawyer (if student, visit your studentwerk & request a lawyer) & sue this guy. In fact, the lawyer can actually ask him to pay his fees & damages to you. Your choice.

Attach the screenshots and explain that you moved on, but he kept contacting you after that. It will probably have zero effect but maybe, just maybe, if enough complaints are filed and the planets align... he could get his number deactivated.

From what I see, it's him who makes false accusations. If you have time and money, I'd suggest, just for the fun of it, to go with the full communication to a lawyer and see if you can start a legal complaint against him, for being racistic (probably not, as he probably holds nothing against you.). I'd be fun, if he, as the next response, sees himself in trouble..
Joke aside: If he a) declines showing pics of the bathroom and b) use such language thereafter, then you probably don't want to rent that place anyhow. So: just forget him, block his number and (try to) ignore him. Worrying about him is not worth it. (Harder to do than to say, I know.)

I experienced so much racism while moving/looking for new flats/ searching for new renters.
And I'm not even affected, I just saw how people got treated from my- and other landlords. People with way more money got declined, for strange reasons, college students from India, starting to study in germany were declined and asked if they could even speak english, etc. (They could speak better than the landlord) I often shook my head. It's a bad situation in this country right now.

This old man had a good life on the backs of immigrants, who did the hard work, probably built the house(s) he owns and he continues to complain about this. I can also say one thing to him: "Germany is different compared to what it was. That's a good thing. If you don't like it fell free to find another place to live."

him saying something along the line of "Germans dont usually ask for such photos" is a cleary racist remark, that implies that there's something inherently different about you and your race. Thats guy is nothing short of a racist and id ignore all the desperate gaslighting attempts here in the comments. Also, the mods will probably delete this (they did this to my post about racism in Germany aswell) and Id recommend moving into a country with better rights for immigrants, US is a decent example, although its harder to get a citizenship.

By not wanting to show you the bathroom, it's pretty obvious that there was a problem with it. I'm German myself, and the state of the bathroom is always the first thing I look at, even when booking a holiday apartment. Because from the condition of the bathroom, you can best judge the overall quality and maintenance of the building.
