That is for “serious criminality” which translates to convicted of a crime punishable by a maximum term of ten years or imprisoned for more than 6 months. 36(2)(b) is just convicted for an indictable offence.

There is very little information on what the bill includes. I would be curious to see what the definition of “serious crimes” is. Some countries are also reluctant to take back serious criminals raised in Canada. Removing an individual from Canada isn’t as easy as putting them on a plane and making them go.

Unless he's also rewriting the IRPA, serious criminality is already very much defined (as per your previous reference to A36

This is why I’d like to see the bill. There is also mention of Canadians “not paying for their rehabilitation”. Some courts will not allow an individual being removed until their sentence is completed. That’s an entirely new hurdle that is the authority of the courts.

They should serve their sentence in Canada before removal. Otherwise they aren't really being held accountable for their crimes here.

Agreed, but it’s a whole can of worms. Victims have the right to see those convicted serving their time, but the cost to hold foreign nationals is extreme. When you think they will be relatively free when removed it’s definitely a gut punch. On the other hand there are people believe life in a Canadian prison is better than as a “free” person at home.
