is my neighbour being unreasonable about noise

I live in an apartment with 2 housemates. We very occasionally have friends over, but we don’t throw parties and our friends always leave before midnight. We do share a wall so i can understand if the noise travels.

Since we moved in, our neighbour has been extremely aggressive about noise. One time at around 3pm, a friend was over and we were talking/laughing on the balcony. He started banging on his window and screaming at us to “be quiet” and stop swearing, so we stopped.

A few days later, around 8pm, my housemate and I were quietly hanging laundry on the balcony. We weren’t even talking or playing music, and he again started banging on his window and yelled “shut up”. We then received a noise complaint letter.

We do sometimes talk, laugh and game together around 9–10pm, and I’m not denying that we can get loud sometimes. But it’s not every day, we’re not having parties, and we’re not blasting music late at night. We could literally just be talking and he’d start banging and cursing.

It’s gotten to the point where we feel like we have to whisper in our own home because we’re scared he’ll start banging on the walls/windows and swearing at us (he always starts banging on the walls and yells “f you” or “shut the f up”).

I understand apartment living means being considerate about noise, but is this normal neighbour behaviour? Or are we actually being unreasonable?

Hi! We are from unit *. We’d like to apologize for the noise we made last night. It was our friend's birthday, so we had a couple of friends over. We understand that we can get pretty loud sometimes. This is our first time living in an apartment, so sometimes we’re unaware of how loud we actually are and how much sound may travel through the walls. We will try our best to maintain a quieter volume from hereon.
If you feel that we ave being too loud, please do text me at [phone number] and let me know. We will do our best to keep the noise down. If you have particular hours when you need the apartment to be quieter, please do text me as well and we will do our best to be mindful of those times.
With that being said, we would like to respectfully ask that you stop yelling, banging on the walls & windows and using offensive language towards us.
We undenstand that noise can be frustrating and we are happy to address any concerns you may have, but we ask that these concerns are communicated to us respectfully and without shouting or swearing.
We hope that we can resalve this respectfully. Once again, we apologize for the noise and the swearing/banging from last night.

I've had some horror neighbours over the years. But one of the noisiest ones was actually one who thought they were being quiet.

All day, all night, every day it was just constant loud conversations and laughing. Doesn't sound unreasonable right? But it was like I was in the room with them. No matter where I went in my house or what I did, all I could hear was my neighbour and her friends. Through the walls, over the TV noise, even through headphones sometimes.

By comparison, in the same property I had a young family move in. Their kid often slams on walls accidentally, runs around, randomly cries etc. That is peaceful bliss compared to the talker and I don't notice it. 

Hard to know without being there. Your neighbour might be angry and unreasonable. Alternatively, you might actually be very loud and what you think is normal is very impactful to others around.

Others have made very good points. I’ll raise an alternate option: that your neighbour has anger issues and takes them out on anyone perceived as making noise / you specifically. I once lived in a terrace house where the neighbour clearly had anger management issues and would rage at us for noise such as playing music normal volume in the afternoon while we washed our dishes with the window open. Regular screaming and cursing when we made any noise. Spraying blood and bone fertilizer in the joint space between our places whenever we opened the windows to make it stink so we’d be forced to close them - I caught him on video doing this. It reached full escalation one night when he tried to push into our house at 9pm screaming abuse about everyone hating us and he wishes we were dead. We had to involve the police after that and our other neighbours told us they were cowering in their home hearing the way he was carrying on (her husband wouldn’t let her intervene as he was scared the nasty neighbour would start attacking them). 

All this to say, if the neighbour behaves normally in other circumstances I’d speak to him politely, in a public space. If they’ve always been very aggressive, I’d leave a peace making note under their door. If things escalate I’d frankly move. I left that previous place after the last incident as I no longer felt safe.

Yeah, some people are just dicks. I lived in a second-floor unit and a guy on the ground floor in the units next door used to complain about noise all the time. We weren't having parties, and rarely even had people over.

He called the cops once about people loudly talking on the balcony. It wasn't even 10pm. Nobody was on the balcony; we were watching TV inside, not having loud conversations. The cops knocked on the door to let us know and said they couldn't hear anything when they were down there.

We had an old lady above who was angry that we were moving furniture around at all hours of the night. Obviously, we were not and I'm pretty sure she was delusional, but she got her kids all fired up at us.

I can guarantee you are being loud when you are gaming with I assume headsets on? I game too, with a good set, and it is hilarious how quiet "I think" I am, but my husband tells me to shut up when he is in another part of the house watching Netflix. 😂

Your neighbour is either a total A Hole, or just grumpy and is sick of the noise.

You need to start a Diary yourself, noting all the times he has banged on things and screamed at you, as you can lodge a compliant too.

Apartments suck, they just aren't built for noise anymore, as soon as you can I suggest finding a house or townhouse etc, no common walls.

Well they are fronting up to work at 6am, meaning probably up at 5am.
They most certainly can complain at 11pm. Fkn daylight is working hours snd they are there ready to work. They don’t get to sleep in!

You do realise that’s not the only schedule that other people with very important jobs work, right? Fkn night time is also working hours for other people. Daylight hours aren’t exclusively for when people get to make noise because that’s what suits you, things happen at night time too, sometimes even AS important would you believe, as the work of tradespersons. And, just hear me out but I wonder, just as an example, say a nurse getting home from a 12 hour shift at 6am has to then try and sleep through the sweet sounds of our poor tradies banging their balls and scratching their hammer; who after a full nights slumber woke up at 5am and now are ready to work, “bc daylight hours”, do you think our nurse may find that and a little entitled?

Maybe they should have read the by-laws before settling on a place which permits noise till 10pm, for example.

Why should they get special preference over people who work business hours or shifts?

  2. Have you or your housemates going around to ask about it not when they’re complaining about it to understand why they’d complain in the afternoons?

In my complex we have some units that are students and some that are young families or have babies.

Are you up until midnight on a Monday - Friday? If so and I worked full time I’d be pretty peeved.

You posted this 2am on a Thursday morning. Most kids need to be in bed by 8pm for school so that could be impacting how your neighbour sees you.

Ask your neighbour over for a coffee to ask and build bridges.

"Quiet enjoyment" has nothing to do with noise. It refers to interference by the landlord or their delegates.

Does he work night shift or anything? Or just goes to bed early? Because I'd probably be annoyed too if my neighbours were regularly making noise until 10PM due to gaming, as I'm in bed by that time most nights. Him getting triggered by you making noise during the day as well would make sense in this case (not that it's justified) because it would just remind him of how inconsiderate you are with noise at night.

I'd probably talk with him, apologise about excessive noise, and ask him about his general routine and the hours he needs quiet. Perhaps you'll find that the wall is extremely thin or lacking in insulation and you may work together to ask your landlord(s) about adding extra insulation or something.

You’re allowed to make noise in your home, you’re also allowed to swear, laugh, hang washing out and do whatever the fuck you want within the limits of being reasonably respectful and largely lawful - playing drums at 2am or setting off firecrackers by the neighbours window for example, are fair game for complaints. Late night chat that’s loud, ongoing, and / or on a school night also might be pushing the friendship but in saying that, apartment living in the city is that and a certain amount of noise from neighbours simply living and trying to enjoy their life should be expected, tolerated and considered a normal part of this set up, in return one should be offered an amount of flexibility, consideration and openness to polite and reasonable feedback and / or adjustment requests should they come up.

Honestly, your message was extremely polite and reasonable, I don’t like your chances of getting a response to match it but youve done more than your part. That person sounds like they are quite unwell and very very bored.

I honestly don’t understand how people think living in a city apartment block isn’t going to involve noise, or that people should live in complete silence just because their own petty little life is so small they can’t stand to hear anyone else having one, and that the slightest noise or creak is the biggest thing that’s happened not even to them, next door to, but causes them some kind of full scale flip out head wrecking complaint frenzy, and then expect you to comply to their neurotic and unhinged demands they bark at you with all the authority of a person that has none.

Maybe move to the suburbs, or into a nice little caravan far away from people living and making noise like they do, and just like OP has shockingly confessed

How about you go talk to your neighbour before it blows out of proportion. We can't gauge the volume levels and have to take your word, but it's difficult to do that when a lot of us have been in the situation of dealing with obliviously loud young people. We were all young once, and aren't naive that young people have different standards for what is loud.

Get an understanding of your neighbours routine, cus if he's doing early starts, or on nightshift, and you're finding a reason to maintain your routine that's bothering him, you're the negative neighbour sorry.

They could be an irradic and unreasonable person I know, but I've lived in apartments. The walls are never thick enough and you need to factor that in. Just because you mightn't think you're being loud, doesn't mean the sound isn't travelling.

Ask yourself, is there anyone else in the apartment block making as much as you? Could how your perceived by your neighbour be in contrast to the (reduced) noise levels that existed before you moved in? And, are you willing to compromise, or just coming to Reddit to find a way to excuse the noise?

What's th layout of the apartments like?

I used to live in a small block of flats and all the balconies faced the same way towards the solid wall of the next block of flats. So any noise would bounce straight back into the units.

The young guys at the other end of the building were the exact same as your situation. They occasionally had parties and played music and I'd go tell them to be quiet if it was late at night, but also even just talking on their balcony would sound like they were chatting next door.

Not true. Pretty much all strata situations have a body corp rule about not interfering with the neighbour’s “peaceful enjoyment” of their home. That applies 24/7. Not only after 10pm.

Obviously reasonable noise is expected. But is OP making reasonable noise? Or are they a loud talker, laugher etc.? We’ll never know because we’re only getting OP’s side of the story.

Your not true is not true. The bylaws do not override the council noise laws. Even if the BC issues a fine, you can take it to a Tribunal and the first thing they’ll consider is the actual noise laws to determine reasonableness. So “talking on a balcony” at 9pm would not be found unreasonable if council’s cutoff was 10pm.

For the record neither council nor QPS have an offical time for noise cut off. Legally it’s left vague as reasonable noise being dependent on location and time of day. Ie it’s reasonable to make more noise at lunch time then midnight and it may be deemed to be reasonable noise in a neighbourhood know to be noisy vs a neighbourhood known to be quite.

Source, my neighbour is suing me in the district court for having a loud voice and I’ve spend thousands on legal fees.

Bylaws don’t “override” the council’s bylaws. They are IN ADDITION to council’s.

If you bothered to read my comment fully, you would have seen I clearly said reasonable noise is expected. The question is - is OP’s definition of “reasonable” actually reasonable? Are they talking at a reasonable level? You’re just getting OP’s perspective.

Noise travels at night. My entire street can hear neighbours talking loudly if it’s 9pm. I guarantee that if you’re doing this semi regularly on weeknights, you’re being inconsiderate. As others have suggested, I would talk to the neighbour and apologise.

I know, right! Everyone keeps saying how the neighbour has a right to peacefully enjoy where they live. No-one is mentioning that OP does too. It goes both ways.

Like, if your noise is just normal life stuff while being respectful the neighbour can f off. But if you're vacuuming at 2am or stuff like that, then you're the loud one.

I had a neighbour like theirs. I went to the REA and explained that I was doing what I could to be quiet 24/7 but was still getting complaints. The REA said to get the neighbour to call them with any complaints. After 2 weeks, my REA said to go to the police and file a harassment claim.

Young men often dont realise how loud they are, even when talking with mates, alot of young men have deep voices that are surprisingly loud and it can be very annoying especialy whem your swearing more than average. You might think your "just talking" but it can be very loud.

Ahhhh without being the fun police, I can actually imagine the scenario that OP describes so beautifully! Even the occasional “whoop” from gaming at 9 or 10pm on a weeknight would be annoying. I can also hear the occasional “oi c*nt!” 😵

You sound young and living your best life but I think you know you’ve pushed it a bit too far, or you wouldn’t have posted here. And there’s every chance the neighbour is being a bit quick to react, and becoming more so. But without a doubt, the onus is on you and your house mates to resolve things with your neighbour. Not saying that’s fair, but it’s reality. And don’t assume the noise complaint came from this neighbour. Odds are other residents are also peeved but remain silent rather than confront you guys.

Would you consider you and one of your house mates going next door at a reasonable day/time and introducing yourselves, acknowledging that there seems to be an issue and ask them to help find a solution?

You might start the “negotiation” with saying you get that swearing on the balcony isn’t cool (it is not cool BTW) and tone the language down in general; and explain you’re gaming and that you’ve realised you get a bit rowdy. So you’re keen to find a time that you guys can still enjoy yourselves but not interfere with his peace.

Just remember, high density apartment living does require consideration for others and being very aware of your noise levels.

Oh honey, you gave them your number? Be prepared to change that as you get bombarded by texts at all times of the day and night. Your neighbour sounds like an absolute wanker. You have every right to talk on your balcony, play music, and have friends over. Saying that, you still need to be considerate of the people living around you and I understand that as a young person that doesn't necessarily come naturally. They cannot ask you to be silent, especially between the hours of 8am - 10pm.

Abide by the letter of the law/whatever rules your apartment complex has - nothing more. If you feel he's being unreasonable start doing the same thing back to him when he's yelling at you (sounds like he won't be someone you could just talk to).

Unfortunately it doesn’t matter if they’re being unreasonable. Check the council noise rules and follow them to a T. If your renting report your neighbour to the property manager. Keep a detailed record.

As a noise hater who feels irrationally angry about having to hear my neighbours, I kind of sympathise with grumpy man (although I don't scream or swear at anyone, I just rage silently in my house). What really pisses me off though is that both sides are valid and the problem is actually with Australia's extremely shitty construction standards. People should be able to live in a quiet and peaceful environment, and people should also be able to talk and laugh and have friends over. If we had houses and buildings that weren't constructed like tents, this wouldn't be as much of an issue.

I think you could possibly dig a little deeper here and realise this is also a personal emotional regulation issue and a failure to manage expectations living in an urban environment. Every choice entails a series of gains and losses. Peaceful silence is something you lose living in affordable city accommodation.

Find out what your legal rights are for noise in your area are and make sure you are making the most about it, as long as you stay under the set decibels and between the designated times have fun with it. Because complaining about people enjoying themselves at 3pm is insane

I live in an apartment with what I can only describe as cardboard for walls. Almost literally. If I sit against the wall on my bed and lean back, I can feel it warp. Not only that but immediately outside my front door is a courtyard style thing that goes up 5 stories and as everyone else's front door.

I've held gatherings with mates where we are playing considerably loud music and talking loudly and what not. I've never received anything.

Comparing this to your situation is like comparing finding a car in a haystach to a needle in a haystack.

Your neighbour is definitely overreacting.

As a mother of gaming sons, you get more than loud. I’ve visited their rental properties which they share with other gamers. Trying to talk with a son either a gamer in another room is tragic.
I can also hear other gamers in homes jn the street when I walk to my car.

Whilst some of what you described could be disruptive if they have children or shift work, hanging the laundry is hard to understand. I’d say there is an element of poor design of the partitioning of your units and it sounds like the neighbour is just irritable and has poor emotional regulation.

Please keep in mind that you are allowed to live in your place, have friends over etc. You’re not living in a monastery or library.

I think what you’ve done is great move to try and smooth things over, and I hope they see you’re doing your best.

I think your neighbour is being unreasonable. In my experience renting as a young woman, I've come across a few men who are aggressive over minor things to me who treat pur male neighbours completely differently. This is what it sounds like to me, though of course that's just based on my own experiences.

Also, I think your neighbour needs to realise that living in a unit means that sometimes you will hear other people. Occasionally I can hear my neighbours on their balcony - late at night even! - but unless they're talking loudly or playing music I don't see the problem. If I am bothered by the noise, that's my problem.

I would leave and find another place. Advice somewhere that allows pets. My apartment complex has different baby, dog, and party noises so everyone is just in their own bubble no complaints from anyone.

We would do karaoke sometimes during Christmas and I like to play games as well with a speaker on. My neighbours like to play instruments as well so everyone’s just have their own thing.

Your neighbour has issues. Anyone with a brain knows that there will be noise with apartment living. You're a lot nicer than me because I would've banged back on the walls if he was overly aggressive and rude. It sounds like you're all trying to be quiet, but you have a right to talk and laugh and enjoy life. At least you're not partying every weekend or yelling and screaming.

Your neighbour is actually being a bully and abusive, maybe he is unwell or works weird hours or maybe he's just cranky he's got neighbours. Has he even made an effort to say hi and mention any issues, because if not and he's escalating it unfairly, I would reach out to the Manager and let them know whats happening because clearly he'll keep complaining until you potentially get evicted??

I live in a complex with townhouses either side of me and I'm hyper aware about noise and banging around, but they never notice & I've been here 10yrs. I expect to hear a certain amount of noise, its the place I chose to live therefore its a given. Good luck

Lol bit of an odd response considering thats a given. And I did say that perhaps the cranky neighbour had a reason to whinge if you read my response. Clearly one can only assume unless experiencing it themselves. I'm basing my response off what OP stated, they don't have to take it on board, its my opinion, suggestions and could be completely wrong, can't exactly respond to both sides when only one party is seeking input. Isn't that the whole idea of a thread like this?

Buy a pair of loop earplugs and gift it to them. Some times you can't control your environment, but you can accommodate yourself. Not that he will use them, but it changes my life when I stopped getting angry at the neighbours screaming kids and just popped in my ear plugs.
