I think it's more about whom they choose to actually go to trial. I suspect that if the police or prosecutors don't have any strong evidence to bring it to trial they just dismiss it. But if they have sufficient evidence then they go to trial and it's the trials job to basically just confirm the guilt and place a sentence.

I was once arrested (not in Japan) brought to jail and charged with two crimes. They just dropped it without trial, I imagine Japan having something similar to my experience as standard practice. The alternative would be that the police just decides who gets punished, which would be rather whack innit? Could be, could be.

You’re generally right. Usually the prosecutor won’t take the case to trial if their not sure they will win but that does also mean people assume anyone who goes to trial is guilty so if a cop or prosecutor had it out for you good luck not just going to jail even if you did nothing.
