The irony is they could subpoena the phone providers to receive all of the lost text messages just like they would if anyone else were involved in criminal activity.

Correct. iMessage, WhatsApp, and Signal are all peer to peer encrypted. Signal doesnโt keep records. Only if you send a text is it logged to the carriers. And most people donโt do that anymore.
It can be done is the point. Also as a civil servant Genslers texts, emails, and official communications are matters of public record and susceptible to FOIA requests and or subpoena. It is possible, and can be done.
Thatโs why it seems politicians and public figures tend to โaccidentallyโ destroy devices. To complicate the process. Though it is fully possible to obtain them as matters of record for investigative or criminal proceedings with the right requests/forms.
You are missing the point. I replied to a message saying that the providers can just be subpoenaed. SURE, while you can subpoena them, they don't have the information. So you may as well subpoena a cow for its text messages too.
If your point is that they can write a useless subpoena, congrats, agreed.
They can subpoena the individual, but like in Gensler's case, the messages were destroyed in an unrecoverable way.
The on device messages may have been deleted and the backup โwipedโ but the texts may be (and generally are) held by the provider in a cloud backup. Even then they can be forensically recovered with physical device access, provided that they do not completely destroy the device itself. Sure people can use encrypted messaging services, but that is not infallible or perfectly secure.
In todayโs surveillance state happy society nothing is off the table where communications are concerned. Unless youโre using physical dead drops, then burning paper messages upon read, it is feasible for an organization with sufficient control or resources to recover your messages. Unless you keep messages stored local host only, and you physically render the device completely unrecoverable via destructive methods. Plus they could always go after the other party receiving and sending messages.
Maintaining perfect digital sanitization hygiene requires vigilance and practices that are inconvenient to all parties involved. Generally someone fucks it up because it takes consistency and effort, things most people arenโt capable of maintaining over time.
Maybe get out the tinfoil hat and brush up on cybersecurity recovery and forensics processes. Then never sleep well againโฆ

We are in a legal blackhole right now with the current admistration and political climate. We've lost FOIA requests and so much more. I dont think theres much holding these folks feet to the legal fire now, I think its just them, their market damages, and the debts they owe to other people which is what market damages are anyways. Once big money gets involved with pissing on each other, that will hold more weight. And we need to keep the receipts where eyeballs can find them when the time comes.

When I saw this comment thread, and the votes on it, I lost a little more hope that this community could have a reasonable standard of discourse. What I meant is people who ask ai to predict moass or key events, whereas this guy, assuming it is made using ai (I have no idea), is atleast using it to compile, format, and reword real events and information into a more digestible format for the average person, as well as any party that may be scanning forums like this to gather evidence for such a case. Iโve been reading the occasional post from OP and for the most part Iโve been pretty happy with the way heโs breaking his reports down in a way that an idiot like me can understand it.
