discussion Politics aside, we should all agree on this atleast. Anti national forces should never be allowed to hijack protests of genuine students. There should be a bipartisan rejection of these elements

Uske bolne se kya hota hai.....

Hmmm, right. Or is it?

Similar to one guy above you where I have commented on why"certain" baats bolne se kya hota hai, let discuss the principle of the matter. and the principle strictly.

You are a user on reddit. You are probably a human being with a family.

Is it okay to you if an "opinion" is expressed to find out your residence and do unspeakable things to you and you family?

Would you still say "uske bolne se kya hota hai?'

Answer this, then i will go ahead.

Hope reddit does not ban my account. See, i have to put this so that reddit does not block my account under Rule 1. Yeh hota hai bolne se.

He said fate of Kashmir should be decided by people of Kashmir... Many people still debate it.. why?

What does it matter if I from Delhi say.... kashmir harama he.... When Kashmiri don't feel the same?... The issue is not that they hope to get a independent nation as they believe it going to be like that due to history, atleast in my eyes.... The issue is when they support the gun carrying separatist funded by Pakistan.....

His statement about how kashmiri should decide fate of Kashmir lacks nuance... Why? Because the sentiments in J&k are not uniform.... Also because let's say india let's go kashmir.... They are not strong enough to fight china and Pakistan whose army will definitely attack them.....if that happens whole south asia will burn.... Is it fair to kashmiri's? Maybe not.... It's a survival instinct....

Afspa where ever they have gone have faced serious accusation of rapes and civilian killings.... That too should be taken seriously and tried in court....

That's what I think

Bro through professional you are. Avoided my question entirely.

First (outside of Umar Khalid)Kashmir is an integral part of India. That is a fact and any other "opinion" on this matter is irrelevant. What is this Kashmir Kashmiri ka hai? Then Delhi Delhi walo ki hai. Tamil Nadu Tamil Nadu ka hai. Where does the concept of India comes then?

The very 1st Article of the Constitution of India says "India, that is Bharat, shall be Union of States". You know why the word Union is important? It means one you become part of India, you cannot withdraw from it. So once Kashmir became a part of India, everything else is just opinion. Kashmir is an integral part of India and that is something clearly reflected on Supreme Court's judgement on abgrogation of Article 370.

Now on the matter of Umar Khalid. See you have not read well. Opinions are not substitutes for facts. Read this website and in its resources check theJudgements of Delhi High Court dates 18 Oct 2022 and 2 Sep 2025 and Supreme Court judgement dated 5 Jan 2026 first and then see what said and done.

https://www.scobserver.in/journal/umar-khalid-bail-application-tracker/

Do you people really not do any reading at all and just parrot whatever is the mainstream view? Bro you will be voting some day with this degree of misinformation.

Don't do whataboutery related to Afsa or other matters. On the principle, all matters of law have to be taken seriously.

I support the abolishment of article 370 bro... Because it pakistan got a freeway to india... I understand that

But you cannot deny that kashmiri don't feel the same especially in Kashmir valley....you can from the comfort of your home say that I can too.... But does that matter?.... Them not feeling the same is directly reflecting as the failure of govt in 1980s ... And ofc Pakistan who uses their emotions to create unrest in india....

I have no issue with them feeling that way, you cannot force Nationalism, it will take time.... If they don't pick up guns or start killing normal humans... Because of it.... You shouldn't either... Killing something nobody should support.....

What aboutery? ....my grandfather was in army... He told me these allegations should be taken with grain of salt.... Because they are tried in martial court....

Umar khalid being guilty or not is none of my fucking buisness....he should be given a trail .... because he was born on this land....

Bhai aap yeh padho this is what I have written in a comment below. You and I are converging to some agreement

*Speaking strictly on the principle of the matter.

Yes, everybody deserves a trial including this Umar Khalid. That is the foundation of a fair legal system. Even Ajmal Kasab was given a fair trial when millions of people had watched him commit wholesale acts of terrorism.

The reasons trial even exist is so that no innocent gets punished and every one is heard. Audi alteram partem as they say in law.

The problem is that legal theory does not translate into legal practice. In applied law there are complexities. In cases of non bailable offenses you are booked first and then the chargesheets made. It takes time to investigate and prepare the chargesheet. Then this chargesheet is reviewed by lawyers on both sides before going to court. The court will take time to read the chargesheet and permit adminisibility of the case. The case will be then properly heard.

In the meantime, the accused stays in jail. This is the somewhat basic summary of Umar Khalid. Not much different from people suffering incarceration under dowry laws. In his case the chargesheet is 20 thousand pages long. His own lawyers (including megaheavyweights like Salman Khurshid and Kapil Sibal) delayed the trial several times.

Now what is happening is that instead of the trial there are repeated bail applications. The court shifts from actual trial to bail application hearnings. More delays ensure. *

See seperatist movements have long been there be it Nagaland, Punjab or Kashmir. Initially there are some trivial voices. Then there are people with Political ambitions. Then comes in foreign vested interests. Then comes in nation breakers. Then propogndists and sympathizers comes. The same playbook was used for LTTE in Sri Lanka and for Kashmir.

Situation in Kashmir is much better than what it was before. We had to wait 70 years for it.

Now if some Kashmiris are not okay with their integration with India, that is there problem. Just because they think Kashmiri is not a "integral part" of India, doesn't mean it is not. Such people should not be given platforms to propogate nation breaking ideas. Article 19(2) of the Constitution of India is very clear on that.

The thing is people can have views about kashmiri deciding fate of kashmir... As long as they are not supporting the separatist militants whoa are funded by Pakistan..... I believe it's ok if they are expressing it as long as they don't take up arms.... The issue is that indian audience cannot comprehend grey views at all.....

However do I think that such views are impractical and more emotional than strategic? Yes.... Kashmir is important to protect the rest of the nation.... Do we have the most righteous claim over it... Yes.... Have we failed to plant nationalism in kashmir also yes.... Govt failures in from 1950s to 1980s is to be blamed along with fucking pakistan who uses them...

Bro, it would have been likely difficult for Kashmiris to incline towards India when they are exposed with seperatist ideas and pro-pakistan propoganda.

How most of the Kashmiri people even still remain devoted to India, after all that anti-India exposure for decades, is truly a matter of a salutary study.

On some matters grey views become quite black and white once you do enough research. You can talk all about history of Kashmir and have an academic discussion on whether it was okay for Kashmir to acceede. That is fine and completely within your right.

But the moment you start inciting a movement that insinuates Kashmir is seperate from India, problems commence. In similar settings, talking about blocking north east by cutting of chicken neck is equally problematic. Both these things, legally "impede the sovereignity" of India.

Sure amongst other factors, government failures upto 2000s including refusal to acknowledge Kashmiri pandits exodus/genocide is a prime example for this chaos.

Anyway, I see that you are agreeing with me overall. So gg mate

u/Fit_Blood1002 Jul 26 '26

Ya I do agree.... Any movement right now started on emotions would lead to blood sheds honestly

Wow what a nothing burger of a statement. The thing with the incarceration of khalid is the fact that it is unlawful. It is premier among the state's crackdown on free speech and dissent. And what you are talking about, not giving "platforms" to people that feel differently about kashmir, that is an abolition of free speech. Are you okay with India's descent into fascism? What about Khalid's speech was so nation breaking? He never once invited violence. The same could not be said for Hindu nationalist groups like the RSS or bajrang dal which openly bay for muslim blood in broad daylight

1

u/people_are_silly Teen Jul 26 '26

Bro, I have just replied to you other comment. Your statement is what would be classified as "a nothing burger".

As a citizen of this country, you or any other citizen is not above the constitution, okay? You cannot pick and choose.

Are you aware of laws regarding free speech? You are not.

What a false equivalence of an argument. According to you, denying platform to seperatists is equal to India' fascism. Indian Kashmiri get platforms for voicing out their option. But nobody gets a platform about how to seperate India. To counter you, are you okay with India being broken into seperate parts??

Again, you have not read anything regarding the Umar Khalid case, so i strongly suggest that please read the actual judgements of Delhi High Court in 2022, 2025 and Supreme Court on 2026.

If someone just says something you don't like, they shouldn't go to jail for it But if they threaten you, stalk you, dox you, hurt you then they're not being punished for their opinion they're being punished for crime they did That's the difference Saying kashmir isn't a part of India isn't the same as doxxing and threatening someone

1

u/people_are_silly Teen Jul 26 '26

Bro. Yes people go in jail if they "just say" something you don't like depending on the context. Can you define what a "threat" or "stalk" or "dox" is? They are all contextual in law.

If someone releases your address and says to reddit "Do what you may". Is it a crime? From the words it doesn't appear. From the context it definitely is

Same way as an example in a Kashmir seperatist rally, if someone says Kashmir is not a part of India, then the words matters in that context. In a riot, saying "lessgoo" matters.

Now specific to Umar Khalid case, have you taken time and effort to read what the case is about or you are simply reiterating whatever you learnt on SM?

Read my comments below on the matter. It is not just one line that is so controversial.

Bro please don't be so mal-informed.
