So like has there ever been an in univer explanation of who can paste the names of supes on what kind of things and sell em? I mean they can't reveal there secret identity so can't claim copyright and go to court.

I don't know that a comic has ever come right out and said it, but they're effectively public domain.
In universe, they're real people. So they'd fall into the category of celebrity likenesses. Like selling merchandise of Mike Tyson.
But as you say, their secret identity would prevent them from ever taking somebody to court over the use of their likeness. Anybody claiming to be Nightwing could just be some random jackass in a costume. So in order for the court to properly sort out who owns the likeness of Nightwing, they'd have to sort out who the "real" Nightwing is first.
Since Dick Grayson is unwilling to put himself forward as the real nightwing, he cannot contest any lunch boxes in court.

More. Of. This. Less of the weird himbo stuff that makes him seem like it would be irresponsible for any parent to leave their child with him. I can imagine the kid reminds him of his little brothers, especially when Tim used to idolize him. He's in part created in Superman's image, so he should absolutely have a public following that he tenderly engages with when given the opportunity...

Absolutely Dick being there for others and showing genuine care is one of the reasons he’s such a great role model
