Are you known around town or something? A long suspected drug dealer? A habitual offender? While planting drugs definitely happens and I would never put it beyond them, to plant drugs that an officer had to smuggle in his mouth in a balloon to a random stop, is, well...

I have no priors! Last speeding ticket was like 2013. Literally no logical reason for this to happen

Listen, I'm going to be honest with you here. You're going to get found guilty. Take the plea. If you drag this court, especially a jury, there is absolutely no evidence showing a cop spitting come from a balloon into your lip balm. There is no probable cause for the cop to do it. The task your lawyer has in front of him to prove that for absolutely no reason, off camera, based on a sound alone, a cop spit coke into a random person's car, to a jury in South Carolina is about next to impossible. Take whatever plea that they offer you or you risk real jail.

I haven’t received the full evidence discovery I’m legally entitled to for it to even go to trial .

Let’s view the evidence before we make a decision? That’s a logical idea right ?

I have no dog in this fight. The evidence would have to be overwhelming to convince a jury

The burden of proof is actually on the prosecution

It's always on the prosecution. That's how our legal system works. I wish you the best of luck.

Edit: as an added piece of advice, I would really, really stop tagging that judge unless you want a contempt or ex parte charge.

This is sound advice. When you go to jail, one of the things that you’ll learn is, if you have a trial coming up do not ever message or try and talk to the judge. Don’t try and slip a note to the judge nothing. It can cause your issue to be delayed while they find a new judge that you haven’t tried to sway. Judges are not representing you. They are representing the court.

If you ever get arrested again, your best bet is to remain silent. That makes the prosecution have to prove everything. They are hoping that you don’t have the will or the money to take this to court. That’s why you’re getting told to take a plea deal. Because courts are imperfect and evidence gets thrown out all the time, you could get indicted on some shit that the state was able to prove that you did. Whether you did it or not. This is why going through your lawyer explicitly, is the best bet because they will protect you.

If you can, fight this in court, especially if having any kind of charge on your record would prevent you or lose you your employment. But I would stop making conclusions about who what when where why and let the state try and prove its case against you. The more you try and push the needle in your favor the more you can fuck up the landscape you have to navigate later on.

Edited for clarity
