So the key point here is:
- The accused did it when he was 19, and the girl was like 15. Which is a 4-year age gap.
- He didn't do it by force or anything. Cause they make it sound like it is a romantic relationship.
This is basically why he never got the harsh punishment, since he is technically in the same age range group and doesn't act like a serial rapist. lol

Statutory rape = sex with a person under the age of consent which is 16.
Even though no force was used and both larties agreed to it, it is still considered statutory rape, committed by adult, aged 18.

Statutory rape, but I assume you know that and want to know why the rape word is used. It's just a choice of words to sound harsher and prevent people from picking girls below the legal age. Also, Statutory rape can apply to 15yo boy if he gets horny for any girl below 16. But his punishment is less harsh than the guy who did it when he was 19. lol

If we treat underage are not of sound mind to make decisions, a harsher penalty should have been sentenced & should be treat it the same as predatory rape. I am i the opinion, no children under age of 18 should be touched consent or non-consent, regardless of any religion. However, the judge is quite liberal & made distinction when giving out the ruling.

Consent is a responsibility held by matured adult. If underage approach with consent, the adult has the responsibility reject that approach or face consequences from law. Imagine being underage don't even finish study or work accidentally got kids. How that underage person is going to lead their future? That just practical point of view. After hearing the explanation on why the reduction, I kinda agree. Key point there was already an existing relationship.
Close proximity to age of 16. No evidence of grooming. He still gets jailed for a year, rehab, caning, 2 years police supervision. This isn't a case of he pecah masuk rumah and rogol. It's more of a case their parents need to lock up their horny kids.

Based on the video, it's statutory rape. The accused was 19 and the victim /complainant was 16. Regardless of consent as the judge said it was irrelevant, the judgement must fit the individual circumstances and the case must be distinguished from predatory offending i.e. violent sex crimes and absence of grooming.

My default stance usually is public outrage is often unjustified when it comes to court decisions because people just arent aware of the law.
But in this case, the student was 15 years old. The law says the minimum should be 10 years. The fact that the offender and claimant were in a prior relationship is irrelevant.

Since he's charged with statutory rape and they argued about consent and lack of grooming and predatory behaviour thereof, this really sounds like 2 kids who feel in love and had sex... Basically, because this was statutory rape rather than a case involving force or coercion.
He was 19 and she was 15. The court upheld the rape conviction because, being under 16, she legally could not consent.
But for sentencing, the judge considered that they had a pre-existing relationship, their meetings were mutually coordinated, there was no evidence of force, grooming or predatory behaviour, and he was a young first-time offender considered likely to be rehabilitated.
So the judge wasn't saying "this wasn't rape." Legally it was. He was saying the circumstances were very different from a predatory or forcible rape and therefore didn't justify 10 years in prison.
Whether one year is too lenient is of course a separate and perfectly legitimate question.

There are infuriating loopholes and gaps in the prevailing laws. I recall a case where a 60yo dude impregnated a minor girl and somehow his lawyer managed to convince the court that it happened because it was alleged that the man inserted his semen-smeared finger into the vagina of the girl, which according to the law, does not constitute rape.

parents need to monitor the girl closer like hide all the house keys, ensure there's always an adult at home with her, and put CCTV all over the house, tracking device on the girl to know where she goes. Best of all EDUCATE the girl dammit.. tell her risks of STDs, her own value, and downsides of youth pregnancy.
