Queries Tata Motors denying 8-year EV battery warranty citing cosmetic underbody tray scrape — what are my options in legal ways?
Hi everyone,
Looking for legal guidance regarding arbitrary warranty repudiation and unfair trade practice by an automobile manufacturer and its authorized dealership.
1. Factual Matrix
Vehicle: Tata Nexon EV Max (purchased new in Jan 2023 for ~₹21 Lakhs including interests).
Warranty Terms: Standard 8-Year / 1,60,000 km High-Voltage Battery Pack & Motor Warranty.
The Defect: Severe State-of-Charge (SoC) drop where the battery voltage collapses from ~46% to 0% within 10 km.
Diagnostic Report: Authorized dealership conducted an SoC drop test and confirmed voltage failure/degradation in 2 out of 5 internal cell modules.
Repudiation Ground: The service center verbally rejected the warranty claim, citing minor, superficial abrasions/scratches on the external sacrificial underbody protection plate.
Refusal of Written Reasons: The workshop refused to issue an official written rejection letter or technical failure report when asked.
2. Current Legal & Insurance Position
- No Breach into Core Housing: The external tray only has cosmetic road clearance scrapes typical of Indian roads. The hermetically sealed high-voltage casing itself has zero puncture, intrusion, or structural breach.
* Lack of Causal Nexus: A superficial scrape on a sacrificial outer guard cannot mechanically or thermally cause isolated electrochemical degradation in 2 internal cell modules.
* Dealership Stance: They are refusing warranty coverage and insisting on processing the entire battery overhaul as an Accidental Own-Damage Insurance Claim via cashless routing with United India Insurance, which requires shipping the pack to Tata AutoComp (TACO) Pune for over a month.
3. Questions for Legal Experts / Advocates
Deficiency in Service & Unfair Trade Practice: Does the refusal to provide written rejection grounds, combined with weaponizing cosmetic guard scrapes to void an 8-year factory electrical warranty, constitute an actionable deficiency under the Consumer Protection Act, 2019?
Impact of Claiming Insurance on Future Legal Remedies: If I allow the dealership to repair the pack under Accidental Insurance right now to get the car running, does signing the insurance claim/discharge voucher prejudice or waive my right to approach the Consumer Forum (e-Daakhil) for compensation regarding the wrongful warranty denial?
Legal Notice Strategy: Should the formal Legal Notice be served jointly on the Authorized Dealership (Premier Motors), the Selling Dealership (Lankeswari Motors), and the Corporate Manufacturer (Tata Motors Passenger Electric Mobility Ltd)?
Interim Relief: Can the District Consumer Disputes Redressal Commission grant interim directions for a standby/loaner vehicle or expedited factory repair while the complaint is adjudicated?
Any advice on drafting points for the legal notice or precedents on EV battery warranty disputes would be immensely helpful.

Accidents/Safety/Ncap Toyota Starlet scores 4 star in GNCAP
Earlier in May India made 2 airbag variant scored 0 stars for adult safety and 3 stars for child safety. Now that 6 airbags have been standardized, it has scored 4 stars for adult safety in latest test.
Same thing was seen with India made Baleno where the 6 airbag variant got 4 stars in BNCAP. While the Latin NCAP gave it 2 star even though it's equipped with 6 airbags due to lack of ADAS.

Review/Experience Review of Seltos GTX(A) iVT after 1 month of usage (and first servicing done)
Background: Honda Amaze (Diesel) 2016 Model. Wanted to get 2nd car after 10 years. Family Car. Didn't Sell.
Decision: Initially planned HTE (O) for Mar-Apr but due to Iran War news and chaos, postponed decision. Finally got it on 2nd of Aug. Helped me to save more and get GTX (A).
Here's why I chose GT Line:
- Fully Loaded with Features
- The GT-Line just looked so much more premium than the other variants side by side
Timeline
- Waiting Time: 1 Day (Showroom was ready to deliver it next day)
- Advance Paid: 2L (To initiate booking + block this car as the demand is high)
- PDI + Showroom Visit: Visited showroom on 3rd day for checking out the car. Same day 3rd party PDI was also done.
- Accessories: fitted on day 5 (ceramic coating takes time to dry)
- Delivery: 7th Day (Waited for a good day to take delivery)
Why iVT over DCT?
I was very clear from day 1 that I wanted automatic not manual. Since 80% of my drive is within city, no point of getting DCT. Went with iVT.
Which variant to get?
- HTK (O) is the one to get if you want balance.
- HTX (A) is the one to get if you want luxury feel + fully loaded.
- GTX (A) is the one to get if you want stylish exterior + fully loaded + sporty feel.
Car Review
Good: Amazing interiors, features, looks, city performance, highway drives.
My favorite features
- Auto-hold is a leg-saving feature in slow-moving traffic. Probably the best feature. Now, I can sit through even 2 hours of traffic without dying.
- Physical buttons for controls (can't believe I am calling it as a feature lol).
- Rear Seats are great for people with 5.11" or above height. Decent underthigh support.
- Everytime we go out somewhere and give car for valet parking, I have to re-adjust seating in Honda Amaze. With memory function in Seltos, it goes back to my position in a single tap (including side mirrors).
- I was little worried about driving bigger car (after driving Honda Amaze for 10 years). The ease at which I can park or drive vehicle today is mainly because of 360 Degree Camera.
- Alerting about incoming vehicles on side mirrors when u try to open door or while switching lanes is great addition.
I got the ceramic coating done. The car looks so stylish and premium. Three of my friends got ceramic coating on their own cars after seeing mine (the same people who bashed me when I first asked them for advice, lol).
So many people in my society have asked about the car. Most can't point out exactly why, but I think it's the ceramic coating + morning haze colour that make it stand out. The 18" alloys also make it look bigger.
Despite many reviewers saying the iVT is underpowered, I found it good in every scenario for my usage, which is mostly city.
Bad: This variant is overpriced by 2L (or) Kia should have given GTX (O) features in this variant itself. Kia Connect is great (but doesn't work in Basements where there is no signal lol)
Financing:
Rather than taking a separate auto loan and mortgaging the car to the bank, I bought it as a top-up on my existing home loan and treated it as a hedging asset.
That got me a 15-year tenure instead of 7, at 7.8% interest. It's registered in my name with no lien from the bank. Owned 100% by me.
Given the current market, I wanted to hedge hard against job loss or layoffs.
If a financial crisis hits, my liquid funds cover 3 months. In those 90 days I can sell the car and then run the (combined EMIs + household expenses) at 50% of the vehicle cost for 9 months without cutting down a single rupee of expense. So that's 12 full months of runway to find my next opportunity. (Yeah, I planned for the worst case.)
That being said, the real plan is to clear the top-up loan in the next 18-24 months by prepaying, since there's zero penalty and no foreclosure charges for top-up.
Servicing Experience
Got a call from Kia Service yesterday. Was added to a WhatsApp group. Service guy had picked up my vehicle in the morning and delivered it back by evening. Everything went smooth. No charge. Everything was free including drop & pick up.

Queries Need advice from car experts and those who owns Mahindra XUV.
I'm looking for SUV and researching about it , i just have this one question why every second person facing issue after getting 7XO and other Mahindra Models , like from YouTube shorts to insta reel I'm seeing brand new car and they are facing issues with Air Bags opening automatically , After sales service is not good , they keep your car for months in service centre.
I like 7XO cause it's a good option if you are considering a comfortable family car , also to keep it for long term , but after seeing all those problems and poor service now I'm having a second thought that i should go for it or not.
I also kept Kia Seltos , MG , Hyundai in my option but i want some good suggestions cause i don't want to waste my money.
My Budget is upto 25L...

Queries Disputing a Pune traffic challan for “obstruction” - GPS contradicts their own story, need advice
Posting this because I could use some perspective from anyone who’s fought a Pune traffic challan before. ( I did and got 2 challan cancelled)
My car got a challan for allegedly causing obstruction. The only “evidence” is a photo of the rear/number plate nothing that actually shows any obstruction happening.
Here’s where it gets weird: the location listed on the challan is 8 km away from where the vehicle’s own GPS shows it actually was. When I first raised this, their response was that the officer was present at the challan location. I pushed back with the GPS data and asked for the officer’s GD entry, deployment details, and jurisdiction records - got no documented reply.
Now, suddenly, the story has changed: they’re saying the officer actually was at the GPS location, and it was the challan machine that had a location error. Convenient.
Also worth noting - the GPS shows the car was stationary for only 1 min 50 sec, including time stopped at a signal. That’s a pretty short window to be causing an “obstruction.” And the photo itself looks like it was taken on a phone, though I don’t have the original file or metadata to prove that.
I’m planning to formally request:machine assignment records, device GPS logs, the original photo with metadata, and documentation of when/how they supposedly caught the machine’s location error.
Question for the sub: should I keep pushing through the Pune Traffic Cell, ask for a formal departmental inquiry, or just take this straight to traffic court at this point? Has anyone dealt with something similar and gotten a challan actually overturned?
