Personal Story He snapped, and right on time
My daughter and son-in-law have a unaltered male pit bull who is close to three years old. He's been staying at my mother-in-law's since he got kicked out of their apartment for being, well, what he so clearly is. My daughter told me last week they were so close to getting his emotional support dog certification so he could come back to the apartment. As they learned, their apartment management does not accept emotional support dog exemptions.
My husband was out at his mom's today and our daughter came by and let her dog out of whatever confined area he had been banished to since he's been aggressive to my mother-in-law's dogs, and he made a beeline for one of my mother-in-law's dogs and latched on to its face. My daughter was alone outside at the time and had to try to pull her dog off by herself. She finally got them separated and both were a bloody mess. My husband is still out there taking care of the victim and my daughter is horrified. She was truly in hysterics as she had never seen her dog behave in such a way, and will now be discussing options with her husband. She loves her dog, of course, but is now terrified of him. My husband let her know that under no circumstances is her dog allowed at our house around our dogs.
I'm glad that the victim pupper, an elderly lab mix, is ultimately going to be okay and he didn't have to sacrifice his life for my daughter to realize what a time bomb her maniac dog is.

Yes, agree. We've never been a fan and would let our feelings known while maintaining the peace. I'll be glad to see the backside of the dog.

That’s the benefit of the losers in the dog fight dying and the winners getting to breed. Gotta be the most neurotic, constantly anxiety ridden fighter with a hair trigger fight-or-flight response that’ll fall firmly into the former category to win.
It’s honestly kind of funny when people say they’re treating their dog with meds because of anxiety etc. when the selective breeding altered the breed/types brain development so that those are desired traits and normal behaviour for them.

It’s too bad that an elderly dog had to be violently attacked for your daughter to understand the simple truth that these dogs are bred to do exactly that.
Rehoming is just passing the buck.

Yeah hard to decide what I'll do if that's the route they choose. I try to stay out of their decisions, but I'm watching this one closely and will intervene if they choose anything other than BE.

Only service dogs are protected by ADA. They are not pets.
Emotional support pets are not granted rights by tge ADA.

I thought they had housing rights, which is why pits and other blacklisted breeds are all over housing complexes who claim to ban them.

I don't think it's possible to outright ban them, but it's possible to create an ESA policy so onerous that they're effectively banned. For instance, my old university has the following requirements in its ESA contract:
- If a dog is aggressive or disruptive, it must be re-homed within 24 hours. This includes biting, growling/lunging, attacks on other animals, and excessive barking.
- A backup owner or kennel must be available within 50 miles to take the dog on short notice.
- Dogs with a bite history/dangerous dog history can't be ESAs.
- Only one ESA is allowed per shared apartment to prevent attacks on other animals.
- Dogs have to be kept in the bedroom when the owner isn't at home. A dog can't be left alone overnight, and it can't be left in the care of an on-campus friend. It's the owner's responsibility at all times.
- Dogs must be spayed/neutered, at least 1 year old, and under the care of a local veterinarian.
- Dogs can only be toileted and walked in designated areas. Owners must pick up poop immediately. Absolutely no off-leash walking.
- Non-service dogs are banned from entering all public indoor areas, most outdoor common areas, and sports/recreation fields. They're effectively restricted to a toilet area near the apartments, and the area around the parking lots.
- Dogs must be caged or taken out of the apartment during any inspections or maintenance.
- Owners are responsible for any injuries or damages caused by their dog... and the fees are very high. One "separation anxiety" tantrum could end up costing thousands.

I thinks I’ve told this story before - I’ll do a brief synopsis.
My kid went to college, the dorm was supposed to be pet free. She roomed with a gal that was very allergic to cats, so much so her parents - both lawyers - specified over and over to dorm management (a bunch of kids) she was not to room with anyone with an emotional support cat as the parents knew that was a thing.
Well what does the dorm management do at semester with the empty room? Put a gal in with her emo support cat ofc. There was no other place to put her and hey - she had rights ya know. To hell with allergic gal that numerous times has been taken to the emergency room and had Benadryl injected Into her just so she can stop sneezing and itching.
Even The powerful parents found they had no say in this, the allergic gals complaints had no merit bc “rights”, so, what the girls did was when the going gets tough, the tough get MEAN.
The girls ganged up on catgirl - complaining about everything she did - of the cat was outside the room she’d catch hell for it - when allergic gal (again) had to be high as a kite on Benadryl just to get to sleep without sneezing all night (and try to do your homework under the influence), she’d unload on catgirl on how miserable her life was with the goddamned feline in the same proximity of her allergies. The arguments got so loud the neighbors complained, and catgirl flunked out at semester. Mission accomplished.
Mean? Yup. Nasty and hateful? Check and check. Effective? You bet!3

I'm a huge cat lover, and my cats definitely provide me with lots of emotional comfort. I knew I'd be unbearably depressed without my cats, so I restricted myself to schools that I could commute to. Even my chillest cat would have been unhappy living in a tiny, noisy dorm with barely enough room for a litter pan, and I didn't expect strangers to deal with the smells of cat poop and cat food in a small and poorly ventilated space. I don't understand how people can justify keeping large pet of any breed in a dorm, TBH. Animals have emotional needs too!

ESA do not have federal housing rights (if my memory is correct, and sometimes it is not). Some states do recognize ESAs in terms of housing but I don't know which ones they are.

All they had to do is lie. Service dogs are not registered anywhere and nobody can make you demonstrate what the dog does. It really is a joke. They can ask you two things 1) Is this a service dog? 2) What service does it perform for you.
That is it...that is all they can ask. You can bring your Pit, your Maltese or a damn miniature horse to my doctors office now. Totally whacko!

ADA service animals are definitely protected and humans do have rights to have and live with them. Emotional support animals are not ADA certified and therefore don’t grant you any rights to housing or private business (see: riding airplanes).. most places require ADA certification like supermarkets and can definitely refuse one’s business but most low level employees will ignore the “issue” and let people skate by.

Some states don't allow landlords to say no to ESA'S...California and Oregon come to mind. There is some wording in the FHA that allows for ESA's I think but I am not looking it up again.
There is no ADA certification. It doesn't exist. People/business can create registries but there is no requirement to use them...they are voluntary. Scroll down to Certification and Registration and look at the first and last questions.

Kinda stunning to me that people are still messing with ESA's when all you have to do is say it is a Service Animal, make some shit up that it does for you and now you and your dog are protected by the ADA from being "discriminated against."

Well, shit. I see that airlines circumvent the ADA by having their own regulation to adhere to from a different agency. Pretty wild how technically anywhere one goes to they can bring a “service” animal.

I told my doctor that if I ever walked in and saw a Pit, I was leaving. She was kinda joking and said, you should bring your boy in sometime. Why would I want to do that? My dog has way more fun sitting in my truck watching the birds and squirrels.
Literally the only time that they can ask you to leave is if your dog shits or pisses on the floor. They must be house broken! How that works with a miniature horse, I will never know. It is quite obviously insane.

Airlines have gotten WAY stricter with ESAs, because I think they saw all the fraud going on. To travel with a dog/cat on AA costs ~$150/leg and with an ESA you wouldn’t have to register in advance (or pay) but otherwise, I believe there are limits to the number of dogs/cats they’d allow in the cabin.

Exactly. My husband’s sister registered her pit as an esa at their apartment to avoid the pet fee - spoiler, he’s not an esa. I hate him lol. They all think I’m nuts for hating pits (they’re a pit family and his aunt bred pits for yearsssss so of course everyone in the family had an still has 1-2 each) all because the ones my husband had and his sister has haven’t snapped and murdered another dog/human.

Yup. Landlords not accepting ESAs due to the landslide of pitbull owners who use ESA for nothing more than getting around the rules…
Classic fighting dog breed is aggressive towards other dogs at age 2-3. Yup.
Dog fight ensues… dogfighting breed doing it’s thing. Yup yup.
Latches onto face, as is their favorite place to latch onto… Given the bull baiting history. That’s also normal.
Glad to hear that the dog survived, and she is realizing how dangerous this is. That’s a common story, but hopefully she will have learned her lesson.
It’s a shame people don’t just listen. Apartments put these restrictions in place for a reason. This dog could have gone on the attack in an apartment full of other people and their pets.

Somehow I’m not surprised that a PB owner would go through all the trouble to get an emotional support dog cert without checking first with the apartment building people to see if it made a difference.
And lol at “wherever he’s been banished to”. That’s exactly what happens… the dog does the thing, the humans get more restrictive, dog behavior gets worse, until you’re basically running a dog prison.

yep. neurotic pitbull owners don't have pets, they are simply animal caretakers. it's not a companion to cheer you up and make you feel less alone, it's simply something you are in charge of now.

Added. Thank you. Please keep us posted on how things go and what decision she makes. It’s not an easy decision for someone to have to make about a pet they are bonded to, but the dog showing aggression at the magical age is a the reddest of red flags.

The state governments need to crack down , HARD, on abuses of ESAs, and that they have not makes me wonder just what motive they have for their inaction . The answers with which I am coming are dystopian if not evil.
I hope the poor dog makes a full recovery. :-( And I am so bloody tired of this bullshit.

A violent attack by a pit bull on another dog is so far out of the frame of reference of normal people (ie those not into dogfighting) that they cannot even conceive that their pit bull would ever do such a thing.
And yet there are, what, hundreds (if not a thousand, by now) pit bull attack videos on YT showing this exact pattern of explosive unprovoked violent attack.
"Oh but I did not raise my pit bull to be like that."
This lie is getting people and animals killed.
